The applicant seeks the following development standards variance approval: 9. Docket No. PZ-2022-00068 V UDO Section 5.09.B Maximum 3.5-ft tall fence in the front yard allowed (with at least 25% visibility), 6-ft tall privacy fence requested. This corner lot is located at 66 Woodland Drive, at 116th Street (Woodland Golf Club Subdivision Lots 28-29). It is zoned R1/Residence. Filed by Seth Goldstein, owner. General Info & Analysis: The Petitioner seeks approval to construct a 6-ft tall privacy fence in the front yard. Bufferyard plantings are also proposed between the fence and 116th Street. Please see the Petitioner’s info packet for more detail on the variance request. The lot is a Corner Lot with two street frontages, hence two front yards. There is also a platted 75-ft front yard building line along the north side of the Petitioner’s lot. Fences in the front yard cannot be more than 3.5 feet tall and need to have at least 25% visibility. The Petitioner proposes a 6-ft tall wooden privacy fence in the front yard with no see-through visibility. However, it will be set back 10 feet from 116th Street multiuse path, and there will also be plantings installed between the fence and 116th Street. Again, please see the Petitioner’s info packet for more detail on the proposal. The Petitioner addressed all planning/zoning review comments. And, the Planning Dept. supports the variance request. Findings of Fact: Please refer to the Petitioner’s Findings of Facts included in their info packet. Recommendation: The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2022-00068 V as proposed, and with adoption of the findings of fact submitted by the Petitioner.
