MEETING MINUTES

MEMBERS PRESENT:
Mayor James Brainard, Council President Richard L. Sharp, Council Members Kevin Kirby, Brian D.
Mayo, Joseph C. Griffiths, Fredrick J. Glaser, Clerk-Treasurer Diana L. Cordray and Deputy Clerk-
Treasurer Lois Fine.
Councilors Ronald E. Carter and Mark Rattermann were absent.
Mayor Brainard called the meeting to order at 6:00 p.m.
Pastor Richard Clark, Central Christian Church of Carmel, pronounced the Invocation.
I Mayor Brainard led the Pledge of Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
Mayor Brainard introduced Nancy Chance, Good Samaritan Network. Ms. Chance presented an award to
the Carmel Fire Department, Carmel FOP and Carmel Financial for their help to those less fortunate
within our community.
APPROVAL OF MINUTES:
Councilor Mayo made a motion to approve the Minutes of the February 20,2006 Regular Meeting.
Councilor Glaser seconded. Council President Sharp called for the question. The Minutes were approved
4-1 (Councilor Griffiths abstained).

RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL:
James Alred, 2519 Pleasant Way, Indianapolis, IN., discussed the Monon Trail (attachment 1).
COUNCIL, MAYORAL AND CLERK-TREASURER COMMENTS/OBSERV ATIONS:
Councilor Griffiths thanked the Carmel Fire Department and Public Safety Officials who responded to his
residence last week.

ACTION ON MAYORAL VETOES:
I There were none.
CLAIMS:
Councilor Mayo made a motion to approve the claims in the amount of $2,937,760.80. Councilor Glaser
seconded. Councilor Glaser questioned the check on page 7 to CSO Schenkel Shultz for $20,541.46.
Councilor Glaser wanted to know if this amount included two plane tickets for Mr. Oliver and his wife
from London to Carmel. Clerk-Treasurer Diana 1. Cordray confirmed that the tickets were included.
There was brief Council discussion. Councilor Glaser asked for the claim in the amount of $20,451.46 be
withdrawn from the claim run for review. Councilor Mayo made a motion to amend his motion to
approve claims in the amount of $2,937,760.80 to $2,917,219.34. Councilor Griffiths seconded. There
was no Council discussion. Council President Sharp called for the question. Claims were approved 5-0.
COMMITTEE REPORTS:
Council President Sharp reported that the Finance, Administration and Rules Committee had not met.
Council President Sharp reported that the Land Use, Annexation and Economic Development Committee
had not met.
Council President Sharp reported that the Parks, Recreation and Arts Committee had not met.

Council President Sharp announced the Third Readinl! of Ordinance Z-485-0S. As Amended; An
Ordinance of the Common Council of the City of Carmel, Amending the Parking Requirements in the
Carmel Zoning Ordinance (Chapter 27: Additional Parking & Loading Regulations). Council President
Sharp referred to Mike Hollibaugh, Director, Department of Community Services, to present this item to
Council. Councilor Mayo made a motion to approve Ordinance Z-485-05, As Amended. Councilor
Griffiths seconded. There was brief Council discussion. Council President Sharp called for the question.
Ordinance Z-485-05, As Amended was adopted 5-0.

Common Council of the City of Carmel, Indiana, Rezoning District Classification (30 Parcels along
Range Line Road from US 31 to just South of 136th Street). Councilor Glaser made a motion to move this
item into business. Councilor Griffiths seconded. Council President Sharp referred to Mike Hollibaugh,
Director, Department of Community Services, to present this item to Council. There was no Council
discussion. Council President Sharp opened the Public Hearing at 6:34 p.m. Seeing no one who wished
to speak, Council President Sharp closed the Public Hearing at 6:34:30 p.m. Council President Sharp
referred Ordinance Z-487-06 to the Land Use, Annexation and Economic Development Committee for
further review and consideration.

Council President Sharp announced the First Readin!! of Ordinance D-1795-06; An Ordinance of the
Common Council ofthe City of Carmel, Indiana, Amending Chapter 8, Article 4, Sections 8-37 of the
Carmel City Code (IS-Minute Loading Zones). Councilor Mayo made a motion to move this item into
business. Councilor Glaser seconded. Council President Sharp passed the gavel to Councilor Glaser to
present this item to Council. There was brief Council discussion. Council President Sharp made a motion
to suspend the rules and not send this item to committee and vote this evening. Councilor Griffiths
seconded. Councilor Glaser called for the question. The motion was approved 5-0. Council President
Sharp moved to approve Ordinance D- I 795-06. Councilor Griffiths seconded. Councilor Glaser called
for the question. Ordinance D-1795-06 was adopted 5-0.
Council President Sharp reclaimed the gavel from Councilor Glaser.

Common Council of the City of Carmel, Indiana, Authorizing the Issuance ofthe City of Carmel, Indiana

Councilor Mayo was elected to the City of Carmel Cable TV Advisory Committee by a
vote of 5-0. Mayor Brainard did not have a nomination for his appointment.

of the City of Carmel, Indiana, Regarding An Intergovernmental Transfer of Real Property (Northwest
Comer of City Center Drive and Rangeline Road - Parcel4B and Parcel lIB); Sponsor: Councilor
Sharp. Councilor Griffiths made a motion to move this item into business. Councilor Mayo seconded.
Council President Sharp passed the gavel to Councilor Glaser to present this item to Council. Council
President Sharp referred to Les Olds, Executive Director, Carmel Redevelopment Commission, for

Mayor Brainard and City Council members,
I'm a huge fan of the Monon Trail: I spoke in favor of it at meeting when it was
still an overgrown, trash-filled gravel path; I use it daily for exercise and to
commute to work; I walk on it with my friends; I ride on it with my kids to school,
and to Old Town for lunch.
I would like to congratulate the city for its efforts to create a pedestrian-oriented
core area as outlined in the Carmel Urban Design Initiative. I would also
encourage the city to add more bicycle lanes to arterial streets as has been done
on 116th St.
With respect to the Speed-Limit Ordinance on the Monon Trail, I think it is
probably necessary for the peaceful co-existence of walkers and bicyclists. A
skinny guy zipping past you at 30 MPH tends to make even the most relaxed
pedestrian a bit edgy.
But speaking as a pedestrian, the biggest threat is not from a 160-pound guy
speeding past at 30 MPH on a bicycle; it is from a 160-pound guy on a cell phone
in a 2000-pound SUV speeding past at 40 MPH. It is the driver who is exercising
his "Might Makes Right" or his "Might Makes Right-of-Way" to disregard the
pedestrian crosswalks where the Monon Trail crosses Carmel city streets.
The Indiana BMV driver's manual is clear on who has the right-of-way at such
crossings:
Pedestrian Safety
Crosswalks or the existence of a pedestrian signal indicates that
pedestrians are nearby.
Please follow these rules and guidelines when pedestrians are in the
vicinity of your vehicle:
. Always yield the right-of-way to pedestrians;
. Do not make a turn that causes a pedestrian to stop, slow down or make
some other special effort to avoid a collision
. If children are in the vicinity, take special care because children are not
fully aware of the dangers of traffic
. Be respectful of others who have difficulty in crossing streets, such as
elderly persons or persons with a visual disability
The Indiana Code is also quite clear:

signals are not in place or not in operation, a person who drives a vehicle
shall yield the right-of-way, slowing down or stopping if necessary to
yield, to a pedestrian crossing the roadway within a crosswalk when the
pedestrian is upon the half of the roadway upon which the vehicle is
traveling or when the pedestrian is approaching closely from the opposite
half of the roadway.

From the Indiana Manual on Uniform Traffic Control Devices for Streets and
Highways:
Section 1A.13 Definitions of Words and Phrases in This Manual
17. Crosswalk-(a) that part of a roadway at an intersection included
within the connections of the lateral lines of the sidewalks on opposite
sides of the highway measured from the curbs or in the absence of
curbs, from the edges of the traversable roadway, and in the absence
of a sidewalk on one side of the roadway, the part of a roadway
included within the extension of the lateral lines of the sidewalk at
right angles to the centerline; (b) any portion of a roadway at an
intersection or elsewhere distinctly indicated for pedestrian crossing
by lines or other markings on the surface.
84. Traffic Control Signal (Traffic Signal)-any highway traffic signal
by which traffic is alternately directed to stop and permitted to
proceed.
According to an Insurance Institute for Highway Safety (IIHS) study, 48 percent
of all pedestrian injuries and 21 percent of fatal injuries to pedestrians occur in
collisions with motor vehicles at intersections. The biggest threat is not from
bicycles, it is from motor vehicles.
If we truly want the city to become more "walkable," we need to remove the
obstacles which prevent citizens from taking their first steps. Until people feel it
is safe to take walking trips which cross a street or let their children cross the
street on a bicycle, the dream of a pedestrian-oriented core will not be realized.
The city council reacted quickly and passed the speed-limit ordinance. I would
like to ask that the City Council react just as quickly to:
1. Post signs at the Monon Trail crossings reminding drivers that
pedestrians on the trail have the right-of-way
2. Begin a program of driver education using the Carmel cable channel.
