ORDINANCE 0-1801-06
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA,
AUTHORIZING THE ACCEPTANCE OF UTILITY PAYMENTS MADE BY CREDIT CARD
WHEREAS, Indiana Code 36-1-8-11 permits the fiscal body of a political subdivision to authorize the
acceptance of "credit card" payments for amounts due and owing to its municipally owned utility; and
WHEREAS, it is in the best interests of the City and the public to provide Carmel Utility customers
with the option of utilizing this convenient method of payment.
NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana,
as follows:
Section 1. The foregoing Recitals are incorporated herein by this reference.
Section 2. That Chapter 9, Article 5, Section'9-217 should be and the same is hereby approved, adopted
and made part ofthe Carmel City Code and shall read as follows:
"Sec. 9.217. Payments By Credit Card.
(a) The Utilities Department is authorized to accept payments for its water and sewer services by credit
card under and pursuant to the procedures set forth in Indiana Code 36-1-8-11, as the same may be amended
from time to time.
(b) If there is a charge to the Utilities Department for the use of a credit card to make such payments, the
Utilities Department may collect a sum equal to the amount of the charge from the person using the credit card.
(c) The Utilities Department shall apply the same uniform procedures for all payments made by credit
card."
Section 3. All prior City ordinances or parts thereof that are inconsistent with any provision of this
Ordinance are herby repealed as of the effective date of this Ordinance.
Section 4. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid,
such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of
same can be given the same effect.
Section 7. This Ordinance shall be in full force and effect from and after its passage and signing by the.
Mayor.
