RE: Revised landscape plan for right-of-way buffer at "The Retreat"
Dear Harry:
I received the revised plans for landscaping along the Westfield Boulevard perimeter
from Mark Timmons and Associates, Inc. This planting plan will provide an almost
complete evergreen screen as these plants mature. The plan is acceptable to the
Department of Community Services.
Because the soil conditions are not optimal for evergreen growth in this' area, I would
recommend the year following installation to begin an evergreen fertilization program,
along with application of minerals (sulfur) to lower the pH of the soil they are planted in.
Please implement these planting plans as soon as possible, taking care to avoid planting
in the right-of-way. If you have any further questions, please contact me at (317) 571-

RE: The Retreat - Landscaping and Right-or-way Concerns
Dear Mr. Todd:
Your voice mail message led me to conduct further research regarding the exact location of right-of-way along
Westfield Boulevard, the previous ADLS approval granted concerning landscaping, and the position of the Hamilton
County Highway Department regarding the placement of Landscaping within the right-of-way.
The following represent the facts as I understand them:
1. Per a deed of dedication recorded as instrument number 199909972239 in the Office of the Hamilton
County Recorder there generally exists in parts a 60 and 70-foot half right-of-way along the frontage of
the subject property. The dedication was recorded on December 17, 1999 and prepared by you.
2. The plan that was submitted by you on December 14, 2000 under our me number 16-01 ADLS Amend
illustrates proposed landscaping located outside of the right-of-way. However, I have scaled out the
plans and see that there is only a 45-foot half right-of-way illustrated.
3. The Plan Commission approved application number 16-01 ADLS Amend on April 17, 2001. This
approval was based on the plans submitted by you reflecting the incorrect right-of-way. The Plan
Commission does not have the authority to approve landscaping within the County right-of-way without
the applicant first having the consent of the Highway Department.
4. I have spoken with Steve Broermann at the Hamilton County Highway Department. He has indicated
to me that the County has not issued permits or approvals that would allow the placement of
landscaping within the right-of-way at the subject location.
Please let this letter serve as an official notice that landscaping may not be installed in the right-of-way adjacent to
the subject property and that Gibralter may not to rely on the approval granted under Plan Commission docket
number 16-01 ADLS Amend. Revised plans must be med with our office showing the correct right-of-way. This is
necessary in order to make a determination regarding the necessary procedure for review by the Plan Commission.

raised regarding the County Highway Department's right of way along Westfield
Boulevard. I have place a call to Mike Howard, the Hamilton County attorney, and
will do my best to follow up with Mike next week in an effort to resolve this matter.
As soon as I hear anything, I will notify you and we can discuss when this matter
should be placed back on the agenda of the Special Studies Committee.
By copy of this letter to John Hennessey, the Gibraltar officer who oversees the
development at The Retreat, I am advising him to notify our landscaping contractor not
to install any additional landscaping along Westfield Boulevard until this matter has
been resolved.

COMMITMENTS CONCERNING THE USE
AND DEVELOPMENT OF REAL EST A TE
GPI at Carmel, L.P. (hereafter, "Owner"), the owner of the real estate located in Hamilton
County, Indiana, and described in Exhibit "A" hereto (hereafter, the "Real Estate"), makes the
following Commitments to the Carmel Plan Commission (hereafter, the "Commission").
1. Description of Real Estate.
A. See Exhibit" A" (Legal Description)
B. See Exhibit "B" (Pictorial Description
2. Docket No. 47-01 CA
3. Statement of Commitments:
A. In consideration of the Commission permIttmg the Owner to complete
construction of its maintenance building in the location shown on Exhibit "B"
attached hereto, the Owner commits that should Hamilton County, Indiana, the
City of Carmel, Indiana, or any successor governmental agency require the
removal of the maintenance building in order to utilize the 150 foot no-build
zone referenced in Commitment 3(1) of the Prior- Commitments described in
Section 8 below, that the Owner will remove the maintenance building at the
Owner's sole cost and expense, and such governmental 'agency shall not be
liable for any cost, damages or other compensation that might otherwise be due
to the Owner relating to such removal.
B. The Owner further commits that the maintenance building to be constructed on
the Real Estate will be constructed of brick and cedar siding or hardy plank
siding.
C. The Owner further commits to landscape the rear of the maintenance building
with blue spruce trees.
4. Bindinf! on Successors and Assif!ns: These Commitments are binding on the Owner of
the Real Estate, each subsequent owner of the Real Estate, and each other person acquiring an interest
in the Real Estate, unless modified or terminated by the Commission. These Commitments may be

5. modified or terminated only by a decision of the Commission made at a public hearing
after notice as provided by the rules of the Commission.
6. Effective Date: The Commitments contained herein shall be effective upon approval by
the Commission in Docket No. 47-01CA of the Owner's Petition to Modify Commitments relating to
the maintenance building.
7. RecordinJ!: The undersigned hereby authorizes the Secretary of the Commission to
record these Commitments in the Office of the Recorder of Hamilton County, Indiana, following the
Effective Date.
8. Enforcement: The Commitments may be enforced by the Commission and the City of
Carmel, Indiana.
9. Prior Commitments: These Commitments amend and modify the Commitments
Concerning the Use and Development of Real Estate dated May 25, 1999, filed with the Department of
Community Services under Docket No. 36-992, and recorded on October 4, 1999, in the Office of the
Recorder of Hamilton County, Indiana, as Instrument No. 1999-09957849.
