. I am seeking a variance for fence height
located at 11125 Westminster Way
. The required maximum fence height in the
front yard (My back yard due to being on a
comer lot) is 3.5 feet tall
. My fence was raised this past fall to 5 feet
from the previous fence that was 4 feet tall
in order to meet our family's needs

. This picket fence was originally erected in 1999 in
its current location-Approved by KHA Board
. The fence was erected in this location due to
previously existing landscaping that prohibited it
from being placed on the building line (reference
picture 3)
. It was raised 1 foot in October 2005 in order to
meet our family's needs-Approved by the KHA
Board

. The fence is set back approximately 20 feet from
the west property line and Westminster Way right
of way
. It does not interfere with the vision triangle at the
intersection of the two streets
. Numerous fences exist within Kingswood that are
higher and are not semi-opaque in design (Privacy
fences) that have been approved by the KHA
Board that meet the different needs of families
. This fence is a simple picket fence erected by a
reputable local company Award Fence

Findings of Faet-Fence Height
. The approval of this variance will not be injurious
to the public health, safety, morals and general
welfare of the community
. Appropriate Setback of 20 feet

property included in the variance will not be
affected in a substantially adverse manner

Findings of Fact-Fence Height
. The strict application of the terms of the Zoning
Ordinance to the property will result in practical
difficulties in the use of the property
. Lowering of the fence to 3.5 feet will not serve
the fences purpose possibly creating a safety
issue for our family
. Current Landscaping will need to be completely
redone along with moving of fence creating
unnecessary financial investment
