Schalliol 1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The Development fits fully within the 1.77 acre parcel of the homeowner, is outside of easements, and is a substantial distance from any other parcel. The Neighborhood Homeowner's Association has approved the development. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The detached garage/pool house fits within the character of the neighborhood, matches home materials, meets or exceeds the level of building quality of the existing home and that of the neighborhood, some other home in neighborhood have much larger detached garages, and the request has been approved by the HOA. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: The unique irregular lot on a hill creates practical difficulties with placing additional attached opportunities for vehicles parking and storage for the property and pool, and strict application of the terms of the Unified Development would prevent homeowner from having similar capabilities such as available in other neighborhood homes. DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No. PZ-2622—Oad r, (,v;65✓f 6a0V is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
