Explanation of why variance/waiver is being requested: The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because it will create a disharmonious aesthetic/disrupt the carefully planned architectural balance of the property as well as significantly reduce the function (of the structure) for the homeowner. The strict application of the terms of the ordinances WILL result in practical difficulties in the use of the accessory building. Constructing the proposed accessory building at an 87.5’ setback from the street (instead of a 95’ setback from the street) still places the building at an acceptable location and allows for the preservation of a 100+ year old tree. Our neighborhood is unique to Carmel with a key characteristic being beautiful mature trees and wildlife.
