We may also have to word the CTE so that if someone hits the pole or the pole falling and damaging someone or something, that the CTE does not imply any liability on the City. I say we wait on the CTE until they have BZA approval. Even though it is not City r/w at this point, it would be good to execute the document now so they (and the City) are covered in the future. We could write the CTE to be "in the event of the real estate becoming r/w". One thing that we should do is make dedication of the r/w at no cost to the City a condition of the BZA approval. Will the petitioner need to do a consent to encroach before or after the variance is heard by the BZA? Or will they need to do one at all?
