HomeMy WebLinkAboutResolution 2020-31 (136th and Keystone Confirmatory) RESOLUTION NO. 2020-31 RESOLUTION OF THE CITY OF CARMEL REDEVELOPMENT COMMISSION CONFIRMING A RESOLUTION APPROVING A DECLARATORY RESOLUTION AND REDEVELOPMENT PLAN FOR THE 136TH AND KEYSTONE REDEVELOPMENT AREA (136TH AND KEYSTONE ALLOCATION AREA) WHEREAS, on September 23, 2020, the City of Carmel Redevelopment Commission (the “Commission”), being the governing body of the City of Carmel Department of Redevelopment (the “Department”), approved and adopted Resolution No. 2020-29 (the “Declaratory Resolution”); and WHEREAS, the Declaratory Resolution designated an area known as the 136th and Keystone Redevelopment Area (the “Redevelopment Area”) as a redevelopment area pursuant to Section 15 of IC 36-7-14 (the “Act”), designated the entire Redevelopment Area as an allocation area pursuant to Sections 39 and 52 of the Act to be known as the 136th and Keystone Allocation Area (the “136th and Keystone Allocation Area”), established an age-restricted housing program in accordance with 42 U.S.C. 3607 pursuant to Section 49 of the Act, and approved a redevelopment development plan for the Redevelopment Area (the “Plan”); and WHEREAS, on October 20, 2020, the City of Carmel Plan Commission approved and adopted a resolution (the “Plan Commission Order”) approving the Declaratory Resolution and the Plan and determining that the Declaratory Resolution and the Plan conform to the plan of development for the City of Carmel (the “City”); and WHEREAS, pursuant to Section 16 of the Act, the Common Council of the City on November 16, 2020, adopted its Resolution CC-11-16-20-01 approving the Declaratory Resolution, the Plan, the Plan Commission Order, and the determination that the Redevelopment Area is a redevelopment area pursuant to the Act; and WHEREAS, pursuant to Section 17 of the Act, the Commission caused to be published a Notice of Public Hearing with respect to the Declaratory Resolution and filed a copy of said Notice in the offices of all departments, bodies or officers of the City having to do with City planning, variances from zoning ordinances, land use or the issuance of building permits; and WHEREAS, pursuant to Section 17 of the Act, the Commission also filed with each taxing unit located wholly or partially within the 136th and Keystone Allocation Area a copy of the Notice of Public Hearing and a statement disclosing the impact of the area; and WHEREAS, at the hearing held by the Commission on the 16th day of December, 2020, the Commission heard all persons interested in the proceedings and considered written remonstrances and objections, if any; and WHEREAS, the Commission now desires to take final action determining the public utility and benefit of the proposed development projects for the Redevelopment Area and confirming the Declaratory Resolution, in accordance with Section 17 of the Act. DocuSign Envelope ID: 42DC7449-42EA-4D9D-BDFF-CE75081DF70C -2- NOW, THEREFORE, BE IT RESOLVED by the City of Carmel Redevelopment Commission, governing body of the City of Carmel Redevelopment District, as follows: 1. After considering the evidence presented at the hearing on the 16th day of December, 2020, the Commission hereby confirms the findings and determinations, designations and approving and adopting actions contained in the Declaratory Resolution. 2. The Commission hereby finds and determines that it will be of public utility and benefit to proceed with the Plan in the form approved by the Commission in the Declaratory Resolution. 3. The Declaratory Resolution is hereby confirmed. 4. This Resolution constitutes final action, pursuant to Section 17(d) of the Act, by the Commission determining the public utility and benefit of the proposed projects and confirming the Declaratory Resolution. 5. The Secretary of the Commission is directed to record the final action taken by the Commission pursuant to the requirements of Section 17(d) of the Act. Adopted the 16th day of December, 2020.
