HomeMy WebLinkAboutResolution 2021-29 (North End declaratory amendment)RESOLUTION NO.2021-29 RESOLUTION OF THE CITY OF CARMEL REDEVELOPMENT COMMISSION AMENDING THE DECLARATORY RESOLUTION AND THE DEVELOPMENT PLAN FOR THE OLD TOWN ECONOMIC DEVELOPMENT AREA (SMOKEY & MONON ALLOCATION AREA) WHEREAS, the City of Carmel Redevelopment Commission (the "Commission") pursuant to IC 36- 7-14 (the "Act") serves as the governing body of the City of Carmel Redevelopment District (the "District"); and WHEREAS, the Commission has previously adopted and confirmed resolutions (collectively, the "Declaratory Resolution") which established and expanded an economic development area known as the "Old Town Economic Development Area" (the "Economic Development Area"), designated certain portions thereof as allocation areas pursuant to Section 39 of the Act, one of which is known as the Smokey & Monon Allocation Area (the "Smokey & Monon Allocation Area"), and approved a development plan for the Economic Development Area (the "Plan") pursuant to the Act; and WHEREAS, due to re -platting and further definition of site of the proposed projects in the Smokey & Monon Allocation Area, the Commission now desires to amend the Declaratory Resolution and Plan (i) to amend the Smokey & Monon Allocation area to include only the four parcels described on Exhibit A attached hereto and to remove all other parcels from the Smokey & Monon Allocation Area, and (ii) to change the base assessment date for the Smokey & Monon Allocation Area to January 1, 2021 (such amendments, collectively, the "2021 Amendments"); and WHEREAS, the 2021 Amendments and supporting data were reviewed and considered at this meeting, and the Commission now desires to approve the 2021 Amendments. NOW, THEREFORE, BE IT RESOLVED by the City of Carmel Redevelopment Commission, governing body of the City of Carmel Redevelopment District, as follows: 1. The Smokey & Monon Allocation Area is hereby amended to include only the parcels listed in Exhibit A attached hereto. All parcels not described in Exhibit A are hereby removed from the Smokey & Monon Allocation Area. 2. The base assessment date for the Smokey & Monon Allocation Area is hereby changed to January 1, 2021. The public health and welfare will be benefited by accomplishment of the 2021 Amendments. 4. It will be of public utility and benefit to amend the Declaratory Resolution and the Plan for the Development Area as provided in the 2021 Amendments and to continue to develop the Economic Development Area, including the Smokey & Monon Allocation Area, under the Act. 5. The Declaratory Resolution and the Plan, as amended by this Resolution, continue to conform to the comprehensive plan of development for the City. 6. The 2021 Amendments are reasonable and appropriate when considered in relation to the Declaratory Resolution and Plan and the purposes of the Act. 7. The 2021 Amendments are hereby in all respects approved. 8. This Resolution, together with any supporting data, shall be submitted to the City of Carmel Plan Commission (the "Plan Commission") and the Common Council of the City (the "Council") as provided in the Act, and if approved by the Plan Commission and the Council, shall be submitted to a public hearing and remonstrance as provided by the Act, after public notice as required by the Act. 9. The officers of the Commission are hereby authorized to make all filings necessary or desirable to carry out the purposes and intent of this Resolution. 10. The provisions of this Resolution shall be subject in all respects to the Act and any amendments thereto. Adopted the 151' day of December, 2021.
