Filed by Kevin Sellers of CSO Schenkel Shultz for the Carmel Redevelopment Commission. General Info: The petitioner seeks approval to construction a building that is approximately 53 feet tall, rather than 45-ft tall, which is the maximum building height in the B-lIBusiness District. This is a difference of 8 feet in height. Analysis: The building is part of the Carmel Redevelopment Commission's initiative to redevelop certain parcels in Old Town. The building will house an art gallery and residential units. Findings of Fact: building height 1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: the variance request is for approximately 8 ft, so that the building can be approximately 53 tall instead of 45 feet tall. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the variance request is for approximately 8 ft, so that the building can be approximately 53 tall instead of 45 feet tall. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: the lack of feasibility of the building renovation may cause the project to not occur, possibly hindering Old Town redevelopment and growth. Recommendation: The department recommends positive consideration of Docket No. 06030012 V.
