The applicant seeks Development Plan, AfCliitecturatDesign, Lighting, and
Signage approval for 6.98 acres, for the purpose of creating a proposed retail
development. .
The site is located at 11000 North Michigan Road and is zoned B3/Business.

The applicant seeks to create a 180,000 sq. ft. retail store and associated parking on 6.98
acres. The site is zoned B3/Business and the retail structure would be located within the
jurisdiction of the Town of Zionsville. As proposed the portion within Clay Township is
comprised of parking lot, associated landscaping, and the entry from US 421. Please see
the packet for full details. The public hearing for this item was held at February 21 st Plan
Commission meeting. One person spoke in opposition.
This site layout requires a variance from ZO 23C.08.02 B - Maximum Front Yard
Setback of 120 Feet. As proposed the structure is located greater than 120 feet from the
US 421 ROW. A variance application has been filed and placed on the April 24, 2006,
agenda of the Board of Zoning Appeals.
The petitioner has also added a pedestrian gazebo along the US 421 right of way near the
pedestrian path. Full details should be presented at this meeting (including elevations and
material samples).
There are some minor issues remaining with the landscape plan (species and planting
locations). The Urban Forrester has approved the plans, with the understanding that these
minor issues will be resolved prior to his full stamped approval.
Petitioner should bring the following to thsi meeting:
1. Timeline for approval for portion under Zionsville' s jurisdiction.
2. Elevations and details of the proposed gazebo (materials, size, lighting, function,
purpose, etc.)
The Department recommen,ds that Plan Commission approve this item as
forwarded by the _~ Committee, contingent upon BZA granting a
variance to the minimum front yard standard.
