The request is an amendment of an earlier submittal. The site is located at 11000 North Michigan Road and is zoned B3/Business. Filed by Joseph Calderon of Bose McKinney & Evans for Heritage RDG, LLC. The applicant seeks to create a 180,000 sq. ft. retail store and associated parking on 6.98 acres. The site is zoned B3/Business and the retail structure would be located within the jurisdiction of the Town of Zionsville. As proposed the portion within Clay Township is comprised of parking lot, associated landscaping, and the entry from US 421. Please see the original packet for full details. The public hearing for this item was held at February 21 st Plan Commission meeting. One person spoke in opposition. This site layout will require a variance from ZO 23C.08.02 B - Maximum Front Yard Setback of 120 Feet. As proposed the structure is located greater than 120 feet from the US 421 ROW. Staff recommends that this site be redesigned to comply with the US421 setback requirements, or attain a variance for the current layout prior to this item receiving committee recommendation. The landscape plan has not been approved by the urban forester. As currently submitted the plan is deficient in required bufferyards and number ofplantings (within the portion under Carmel jurisdiction). Petitioner should bring the following to the Committee meeting: 1. Update on when a revised, compliant landscape plan will be submitted. 2. Revised site plan showing convenient pedestrian connections from the multiuse path on US 421 to the retail structure (and installation of path ifnot already constructed). 3. Timeline for approval process for portion under Zionsville's jurisdiction. 4. Decision on whether site will be redesigned or a variance sought for the non compliant minimum setback.
