4i . Board to consider Variance Renewal on Docket No. BA 37-71, for house
trailer being used for living quarters, located 11415 River Dr. E.
Filed by Jewell Chaney.
Mr. Chaney was not present and they have not sent a letter requesting
renewal.
Mr. York asked the Building Commissioner' s office to write a letter
notifying Mr. Chaney that, unless they appear at the November meeting, their
variance will be terminated and Mr. York so moved. Seconded by Rev. Saunders.
Motion carried.

2h. 7:45 P.M. , Public Hearing on Docket No. S 45-80, Special Exception
Application for Hope Church (addition to existing church) , located at
2500 E. 98th Street in S-2 zoning.
Filed by Donald Walker for Hope Church.
Mr. Walker was present.
Because the petitioner failed to get legal notices sent out , the public
hearing cannot be held this evening and was tabled by Building Commissioner.
The petitioner requested that the Board act tonight anyway because they
are anxious to start construction before winter.
Mr. York stated that the Board cannot hear this item at this meeting due
to improper notice as required by law.
Mrs. Litvan stated that it would be precident setting and not in the best
public interest to allow construction to begin before the public hearing date.
Mr. Adler commented, if there was an objection to this addition to the
church, that the consequences could include personal liability to the Board
to knowingly act in an illegal manner.
Mr. James Schopp, 2533 E. 98 St. , stated that he has a letter implying
only that an educational wing would be built on the south side of the church
and that only a building permit is involved and not a variance.
Mr. York related that, in order to get the building permit, a special
exception is needed.
Mr. Schopp stated that he feels that the public in the area of the church
does not know what all is involved here and they should have the opportunity
to present themselves.
The petitioner asked the Board if it 'could hold a special meeting to hear
this item after the 15 day legal notice requirement time.
After discussion regarding this matter, Mr. Geltz moved that the Board
hold a special meeting for public hearing on S 45-80 for Hope Church on
November 13 at 7:0Q P.M. at 11 1st Ave. N.W. (across the street from City
Hall ) ; also the Board will hear Docket No. 46-80 for St. Peter' s United
Church o Saipt.if they desire. Seconded bey Mrs. Skeens. Motion carried.

3h. 8 :00 P.M. , Public Hearing on Docket No . BA 42-80, Sign Variance Appli-
cation for Southern Mills Outlet. Requesting larger sign than ordin-
ance allows. Location is at former Morgan Pharmacy, 930 S. Range Line
Road in B-4 zoning.

The public hearing opened at 8 :19.
Barrba r Richard made the _presentation showing a diagram of their propos-
ed sign w is is ft. . and larger than the ordinance allows.
The sign is to be brown background with ivory lettering and is to be
lighted at night.
Mrs. Litvan moved that BA 42-80 be approved as presented. Seconded by
Mr. Geltz.
