Michigan Road Apartments Variances DOCKETS NO. PZ-2021-00224 V, 00228 V, 00234 V, 00240 V, 00241 V, and 00244 V Dear Joe: I'm writing on behalf of the adjacent property owners and interested parties to the continued pending of the above Dockets for the Michigan Road Apartments. As you are aware, the Plan Commission voted this project down at the May meeting and we are unaware that any appeal was filed as a result of the Plan Commission's actions. Those concerned about this project believe it is patently unfair to continue to allow these Variances to pend and therefore have placed a responsibility on the community to continue to review and make decisions on whether they need to attend a BZA hearing or not. It should be noted that the developer has continued this matter on the BZA agenda a number of times without action. At some point, and we believe it to have already occurred, the Board of Zoning Appeals should dismiss this Petition so that it no longer continues to appear on the Docket and causes the community confusion as to whether it will be considered. It should also be noted that there really is no project for which these Variances now apply as no new applications have been filed. It simply is wrong to have the public to continue to review this Docket and make plans to deal with issues if it suddenly appears primed and moved forward. If not totally dismissed by the Board of Zoning Appeals, which we believe is the correct action, at the very least, it should not continue to be tabled and the developer should be required to re -notice when and in the event they ever seek to request Variances from the Board of Zoning appeals.
