DEPARTMENT REPORT
MONDAY, JUNE 27, 2022
(V) Weaver Fence Height Variance.
The applicant seeks the following development standards variance approval:
1. Docket No. PZ-2022-00091 V UDO Section 5.09.B Maximum 42” fence in front yard
allowed; 48” requested. The site is located at 3803 Cole Ct. (Weston Ridge Subdivision Lot 65) and is
zoned S1/Residence-Cluster. Filed by Michael Weaver, owner.
General Info & Analysis:
The Petitioner seeks approval to erect a 48-inch-tall decorative fence in the front yard, when only a maximum
of 42 inches is allowed. Please see the Petitioner’s info packet for more detail on the variance request.
The lot is a Corner Lot with two street frontages, hence two front yards. There is also a platted 25-ft front yard
building line along the north side of the Petitioner’s lot. Fences in the front yard cannot be more than 3.5 feet
tall and need to have at least 25% visibility. The Petitioner proposes a 4-ft tall black aluminum decorative fence
in the front yard with at least 25% visibility. This is a 6-inch variance in fence height, or a 14% increase.
The fence will encroach approximately 3.7 feet into the platted front yard area along the north side of the lot.
The fence will be located 21.3 feet south of the north property line.
The Petitioner received HOA (Homeowners Association) approval, too.
The Petitioner addressed all planning/zoning review comments. The Planning Dept. supports the variance
request.

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2022-00091
V, and with adoption of the findings of fact submitted by the Petitioner.
