DEPARTMENT REPORT
MONDAY, JUNE 27, 2022
(V) Paul Garage Setback Variance.
The applicant seeks the following development standards variance approval:
2. Docket No. PZ-2022-00093 V UDO Sections 3.64.C.2 and 5.02.A.5 Minimum 5’ side
yard setback allowed; 3’2” requested. The site is located at 121 1st Ave NW (Henry Roberts Addition
Lot 1) and is zoned R4/Residence and Old Town Overlay Character Subarea. Filed by Sam Milligan of
North Ridge Construction on behalf of Thomas & Dianne Paul, owners.
General Info & Analysis:
The Petitioner seeks approval to build a detached 2-car garage in the back yard, which will be accessed from a
side alley. The proposed setback is 3.17’ from the north property line (which is also the alley). Please see the
Petitioner’s info packet for more detail on the variance request.
The Unified Development Ordinance (UDO) requires an accessory structure be located at least 5’ off the alley
easement or right of way line. The UDO also requires a minimum of 5’ side/rear yard building setbacks for
structures located within the Old Town Overlay district.
Since the Petitioner requests a 3.17’ setback from the north property line (which is also the alley right of way),
this is a variance of 1.83’ or a 36.6% reduction in setback.
The garage will match the existing house in colors/materials.
The Petitioner addressed all planning/zoning review comments. And, the Planning Dept. supports the
variance requests.

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2022-00093
V, and with adoption of the Findings of Fact submitted by the Petitioner.
