DEPARTMENT REPORT
MONDAY, JUNE 27, 2022
(V) Powell Pool Variances.
The applicant seeks the following development standards variance approvals:
3. Docket No. PZ-2022-00094 V UDO Section 5.02.7 Minimum 3’ setback from easements
required for pools/decking, 2’ setback from easement requested.
4. Docket No. PZ-2022-00095 V UDO Section 2.04 Maximum 35% lot cover allowed, 45.3%
requested. The site is located at 14436 Salem Drive East (Ashton Subdivision Lot 106). It is zoned
S1/Residence. Filed by Kyle Powell, owner.
General Info & Analysis:
The Petitioner seeks approval to install an in-ground swimming pool. Variance are requested for lot pool
location and for lot cover percentage. Please see the Petitioner’s info packet for more detail on the variance
request.
Pool Setback Variance:
A 7.5’ wide easement runs along the north side of the lot, and a 20’ wide easement runs along the set side of the
lot. Accessory structures, such as swimming pools, are required to be located at least 3-feet away from any
easement. The Petitioner requests approval for the pool and its decking to be located closer to the easement, so
that its setback from the easement is closer to 1-2 feet from the easement. The pool and its decking will not
encroach into the easement, however. (Also, the proposed Retaining Wall has been redesigned so that it too will
not encroach into the easement but will run right up against it.)
Also, the pool pump/equipment will be located 20+ feet from the side property line. (The minimum is 10-ft.)
The pool pump will be a quiet model so as to limit noise/vibration.
Lot Cover Variance:
The Petitioner seeks approval for 45.3% lot cover, when the maximum allowed is 35%. Things that count
towards lot cover are pavement, building footprints, pools, etc. This is an increase of 19.15%. The Petitioner
should continue to work with the Carmel Engineering Dept. and the Building Permits Dept. to gain approvals
for the swimming pool permit, should the variances be granted.
The Petitioner should continue to work with the Carmel Engineering Dept. through the residential pool permit
process.
The Petitioner addressed all planning/zoning review comments. And, the Planning Dept. supports these
variance requests.
Findings of Fact:

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of Docket Nos. PZ-2022-00094
V and PZ-2022-00095 V, with adoption of the findings of fact submitted by the Petitioner.
