The applicant seeks the following development standards variance approval: 5. Docket No. PZ-2022-00096 V UDO Section 3.64.C.3.c Maximum 45% lot cover allowed, 49% requested. The site is located at 241 First Avenue SE (John A Phelps’ Addition Lot 6A). It is zoned R3/Residence and Old Town Overlay, Character Subarea. Filed by Robert Anderson of Faegre Drinker, on behalf of Jim Thomas, owner. General Info & Analysis: The Petitioner seeks approval for a swimming pool and hardscape improvements to the property. The maximum allowed lot cover in the Old Town Overlay District is 45%, and the Petitioner requests 49%. This is an increase of 4%. Please see the Petitioner’s info packet for more detail on the variance request. Prior BZA variances were granted for house width and lot width under docket nos. 19050006-7 V. A maximum 55-foot-wide house is allowed, and 64 feet was granted by the full 5-member BZA. Also, a maximum 90-foot- wide lot width is allowed, and 132 feet was granted. The Petitioner installed underground stormwater detention with the first phase of building the house, so the Carmel Engineering Dept. has no comments or concerns for this variance request. The swimming pool equipment will be of a quiet model, and that documentation has been provided to Planning Staff. The Petitioner addressed all planning/zoning review comments. And, the Planning Dept. supports the variance requests, with the condition listed in the Recommendation below. Recommendation: The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2022-00096 V, with adoption of the findings of fact submitted by the Petitioner.
