• I have read the Petitioner's info packet and Staff's department report. I will approve this variance subject to the
approvals stated by Staff.
Approved 1-0 with the conditions of obtaining the proper approvals from the Carmel Engineering Department and
the Hamilton County Drainage Board.
(V)Hoge Garage Variances.
The applicant seeks the following development standards variance approvals:

• Is there any other requirement for the dedication requirement of 45-ft half street ROW?Would I have to construct

The applicant seeks the following development standards variance approval:
7. Docket No.PZ-2022-00066 V UDO Section 5.02.B Minimum 25-ft setback behind the front line of
the principal structure required,approximately 90-ft in front of house requested.
The 5.1-acre site is located at 9777 Ditch Rd. and is zoned S1/Residence and SFHA/Special Flood Hazard Area.

• I have nothing else to add than what I presented in my info packet. I'm here to answer any questions.
Public Comments:
Ray Kiswain,adjacent neighbor to the south: I object to this variance request. Mr. Greco placed his shed in front of both
of our houses. It's a massive shed. I can see outside my window. I believe this shed structure will hurt my property value.
I have listed my property for sale, and I worry it will hurt the future sale of my home and property. We have a shared
driveway,and the first thing you see when you drive up to both properties is the shed. The petitioner has 5 acres,and he
chooses to place it right here. There's space on the northern portion of his property and he selected to place is on the
southern portion of property.

Rebuttal to Public Comments: Peter Greco:
• The shed is approx. 100-ft away from my neighbor's home, and not right outside of his window
• We placed the shed at this location for convenience and access off the driveway. Due to a floodplain and slope,
we have no buildable area behind my house.
• My house is so far removed from public view on Ditch Road,you can't see the shed from the road
• My neighbor is moving away soon, so this won't affect him
• The shed is made by professional Amish builders and is made of high quality

• Staff recommends positive consideration of this variance with the adoption of the Petitioner's findings of fact
Board Comments: Leo Dierckman:
• Is the shed already built and in place?Peter Greco: Yes, it was delivered on a truck as already built.
• I would request that the Petitioner to plant trees/landscape, behind the shed for buffer. I don't believe a fence is
necessary. Peter Greco: I offered to plant some Norway Spruce trees behind the shed, and my neighbor did not
care for that. I will plant whatever is required or necessary. I measured 5-ft to 6-ft of space behind the shed and
the shared property line.
• I want the Petitioner to work with the Urban Forester on a landscape plan that will include the specific tree
species, spacing, and number of plantings required to provide that buffer. I want these plantings installed within
30 days of this approval.
• After a number of years,the trees will grow and will act as a natural buffer to your neighbor to the south
Approved 1-0 with the Conditions that a landscape plan is worked out and approved by the Urban Forester,and
the plantings are installed by the Petitioner within 30 days of the landscape plan approval.
(V) Goldstein Fence Variance.
The applicant seeks the following development standards variance approval:
8. Docket No. PZ-2022-00068 V UDO Section 5.09.B Maximum 3.5-ft tall fence in the front yard
allowed (with at least 25% visibility), 6-ft tall privacy fence requested.
This corner lot is located at 66 Woodland Drive, at 116t Street(Woodland Golf Club Subdivision Lots 28-29). It is
zoned R1/Residence. Filed by Seth Goldstein, owner.
Petitioner: Seth Goldstein:
• We found that it will better that we move our fence line 15-ft to the west,well within our eastern property line, so
that the fence is placed within the existing tree line. Angie Conn: Staff supports this change.
