Approval of Minutes of Previous Meeting:
A Motion made by Grabow and seconded by Dierckman to approve the February 28,2022, BZA meeting minutes.
Approved 5-0.
Approval of the Negative Findings of Facts of the Administrative Appeal,Docket No.PZ-2022-000:
A Motion made by Hawkins and seconded by Grabow to approve the Findings of Fact from the February 28,2022,BZA
meeting. Approved 5-0.

The site is located at 431 E.Carmel Dr. It is zoned B8Business and is not in any overlay zone. Filed by Jim Shinaver of
Nelson&Frankenberger LLC on behalf of Bob Goins of K&J Investments XVL,LLC.
Petitioner:Jim Shinaver
• Present tonight are Bob Goins and Don Silver with Culver's,and Bill Terry,with Weihe Engineers
• Presented aerial site map of the subject site
• We are currently being heard by the Cannel Plan Commission for DP and ADLS approval
• We have a shared access easement with the site adjacent to the east,Fazoli's
• This site is a former car wash business that has been vacant. The existing building will be demoed,and a new
building will be built in its place.
• Presented Site Plan
• The UDO requires 70 spaces,and we are proposing 46 spaces.Most of the customers will be using the drive thru.
• The UDO requires 60%lot coverage,and we are requesting 68.3%
• Presented Elevations, the UDO only allows one sign per street frontage. We are requesting a non-electronic
ground monument sign adjacent to E.Cannel Drive,and a wall sign on the north elevation.
• Culver's is excited to become part of Cannel's business community
• Staff recommends approval of our variance requests
Public Comments: None
Department Report Angie Conn:
• Their architecture and design are currently being reviewed by the Cannel Plan Commission
• Cannel Engineering Dept.has no concerns with their lot coverage request
• Staff is in supportive of their signage,wall,and ground sign.
• We recommend positive consideration of all three variances
Board Comments:
Brad: Does the 46 parking spaces include the eight,wait for pickup spaces?Jim Shinaver: 46 just includes for the
customers that want to come inside. We will have 46 plus 8(54)total spaces.
Brad: Can your client make sure their employees don't park in the Buchanan and xx funeral home parking?Jim
Shinaver: Yes,we can agree to that and make it a conditional of approval.
Jim: Can you show me where the ground sign is located at?Jim Shinaver:Shows location of ground sign on site plan,
the ground sign will not impede or obstruct with the sight line of vehicles exiting and entering this site.
A Motion made by Grabow and seconded by Broach to approve Docket Nos.PZ-2022-00040 V,PZ-2022-00042 V,
and PZ-2022-00043 V condition to instruct all Culver's employees not to park at the Flanner Buchanan Funeral
Home parking lot,and the adoption of the Petitioner's Findings of Fact.
Approved 5-0.
