DEPARTMENT REPORT
MONDAY, JULY 25, 2022
(V) Rice Fence Height Variance.
The applicant seeks the following development standards variance approval:
1. Docket No. PZ-2022-00099 V PUD Ordinance Z-598-14, Section 7.1.C Maximum 36” tall
fence in front yard allowed, 48” fence requested.
The site is located at 1484 Windpump Way (Sunrise on the Monon Subdivision Lot 27). It is zoned
PUD/Planned Unit Development. Filed by Justin Rice, owner.
General Info & Analysis:
The Petitioner seeks approval to erect a 48-inch-tall black aluminum decorative fence in the front yard (4-ft
tall), when only a maximum of 36 inches is allowed (3-ft tall). This is a variance of 12 inches, or 33% change.
The fence will be located on the western half of the lot. Please see the Petitioner’s info packet for more detail
on the variance request.
The subject lot is a Corner Lot with two street frontages, hence two front yards. The front of the house faces
east towards Windpump Way, and the side/rear of the house can be seen from Sundown Circle. Fences in the
front yard cannot be more than 3 feet tall per the Sunrise on the Monon PUD Ordinance. The Petitioner
proposes a 4-ft tall black aluminum decorative fence in the front yard, along the west side of the lot that fronts
on Sundown Circle. The fence will sit back from the Sundown Circle sidewalk a few feet.
The Architectural Review Board for the Sunrise on the Monon neighborhood has also approved the fence
design/location.
The Petitioner addressed all planning/zoning review comments. The Planning Dept. supports the variance
request.

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2022-00099
V, and with adoption of the Findings of Fact submitted by the Petitioner.
