(ACE) has been contracted by Heritage RDG, LLC to prepare Due Diligence documentation for the property located at the southwest corner of the intersection of Michigan RoadlUS 421 with Bennet Parkway, Carmel, Hamilton County, and Zionsville, Boone County. On behalf of Heritage RDG, LLC, ACE is requesting your concurrence that no jurisdictional wetlands are located on the subject parcel. Both parcels of land are generally flat with a fence row separating the northern and southern parcels. Access to the southern parcel can be obtained from Michigan RoadlUS 421 or from the business park to the south. Access to the northern parcel can be obtained from Michigan RoadlUS 421 or from Bennet Parkway. The site was historically farmed. Review of the historic aerials indicates that both parcels have been farmed since at least 1941. Nearby properties currently consist of residential and commercial land uses. A Wetland Determination evaluating the two parcels was completed on August 24, 2005. The parcels include approximately 40 acres of land that is currently undeveloped. The day was clear with a temperature of approximately 80 degrees Fahrenheit. At the time of the field reconnaissance, the southern parcel was farmed in field com, and the northern parcel was fallow land. ACE did not observe any areas on either parcel with wetland hydrology or vegetation. No structures were present on either parcel. No evidence of surface hydrology was evident on the historic aerials reviewed. The Hamilton County GIS indicates an unpaved ditch on the southern parcel; however, no indication of this ditch was observed in the field. Review of the National Wetland Inventory did not indicate any potential wetland areas on the subject parcels. Review of the Hamilton County NRCS wetland mapping indicates both parcels as non-wetland or prior converted. Mr. Tim Smith September 2, 2005 Page 2 Based upon the observed. site conditions, no wetlands, Waters of the US, or Waters of the State were identified within the investigated area. Although some areas of the site have mapped hydric soils (Brookston silty clay loam), no areas that contain hydrophytic vegetation or indicators of wetland hydrology were noted. Therefore, the,site does not satisfy the three criteria required for a determination of a jurisdictional wetland. The site is an active farm or fallow land with no wetlands or waters. These comments have been prepared under the authority of the Fish and Wildlife Coordination Act (16 U.S.c. 661 et. seq.) and are consistent with the intent of the National Environmental Policy Act ofl969, the Endangered Species Act ofl973, and the U. S. Fish and Wildlife Service's Mitigation Policy. The proposed project will have no significant effect on wetlands and will not affect any Federally endangered species. Other project impacts will be minor in nature. Based on a review of the information you provided, the U.S. Fish and Wildlife Service has no objections to the project as currently proposed. We appreciate the opportunity to comment at this early stage of project planning.
