Section 1 - SUMMARY
A Phase I Environmental Site Assessment has been prepared by American Consulting, Inc., evaluating
the parcels located in the southwest comer of the intersection of Michigan Road/US 421 with Bennet
Parkway in Carmel, Hamilton County and Zionsville, Boone County, Indiana. The parcels include
approximately 40 acres of land, currently undeveloped. The site was visited on August 24, 2005. The
day was clear with a temperature of approximately 80 degrees Fahrenheit.
At the time of the field reconnaissance, the southern parcel was fanned in field corn, and the northern
parcel was fallow land. No structures were present on either parcel.
Both parcels of land are generally flat. Access to the southern parcel can be obtained from Michigan
Road/US 421 or from the business park to the south. Access to the northern parcel can be obtained from
Michigan RoadJUS 421 or from Bennet Parkway. Nearby properties consist of residential and
commercial land uses. The subject site was historically farmed.
A database search of appropriate federal and state records conducted in accordance with ASTM
Standard Practice E 1527-2000 revealed ten non-geocoded sites within appropriate zip codes. None of
these sites appears to be within the appropriate search radius of the subject parcels.
In the opinion of the preparer, the parcel evaluated by this Phase I Environmental Site Assessment, as
identified on the accompanying maps, contains no known recognized environmental conditions that
would present limitations to the development of the property.
Section 2 -INTRODUCTION
American Consulting was retained by the Heritage RDG, LLC, to conduct a Phase I Environmental Site
Assessment on two parcels of land located southwest of the intersection of Michigan RoadlUS 421 with
Bennet Parkway, in Cannel, Hamilton County and Zionsville, Boone County, Indiana. The parcels
include approximately 40 acres of undeveloped land.
The purpose of this Phase I Environmental Site Assessment is to identity recognized environmental
conditions associated with this property, including those related to current and past activities at the site
and on adjoining parcels, and to afford a potential purchaser protection under the provisions of the
innocent landowner defense. This Phase I Assessment has been conducted in conformity with the
American Society for Testing and Materials (ASTM) Standard E 1527-2000, Standard Practice for
Environmental Site Assessments: Phase I Environmental Site Assessment Process and includes a review
of federal and state records and databases, a review of the property's history, a site reconnaissance, and a
review of published information pertaining to the area in general.
Section 3 - SITE DESCRIPTION
3.1 - Location and Legal Description
This site is located in the northeast 1,4 of the southeast 1,4 of Section 1, Township 17 North, Range 3 East,
Eagle Township, Boone County, Indiana, and the northwest 1,4 of the southwest ~ of Section 6,

Township 17 North, Range 3 East, Clay Township, Hamilton County, Indiana. More generally, the site
is located in the southwest comer of the intersection of Michigan RoadlUS 421 with Bennet Parkway in
Carmel and Zionsville. Please refer to the accompanying maps for the location of the subject parcel.
3.2 - Site and Vicinity Characteristics
The tract is located on generally flat land and is accessed via Bennet Parkway along the north side of the
parcel or Michigan Road along the east side of the subject parcel. Nearby properties consist of
agricultural, residential, and commercial properties. This area is rapidly developing.
Neither parcel contained any structures, although the parcel card for the northern parcel indicated a
farmhouse had historically been associated with the property. At the time of the field reconnaissance,
the northern parcel was fallow, and the southern parcel was farmed in field com.
The existing ground elevation on the subject tract of land is approximately 900 feet amsl. Groundwater
is assumed to flow west toward Eagle Creek, but local features may influence hydrogeological factors in
a specific location.
Soils in the area include Brookston silty clay loam, Crosby silt loam, urban land treaty complex, and
urban land Crosby complex. Brookston silty clay loam is considered to be a hydric soil capable of
supporting wetland vegetation and hydrology. This investigation did not formally evaluate the presence
of potential wetland resources on the property.
3.3 - Descriptions of Structures, Roads, and Other Improvements on the Site
The subject tract of land is undeveloped. A wooded fencerow runs east and west separating the two
parcels. The northern parcel is undeveloped. The dominant vegetation is old field species, which have
been mowed. The southern parcel is farmed in row crops. Surrounding parcels are generally developed
as light industrial or residential.
The area is served by municipal utilities. Several utilities including sewer, electric, and cable were
noted along US 421\Michigan Road and Bennet Parkway. The attachments to this report include photos
of the various features.
3.4 - Information Reported by the User
No information was provided by the current landowner.
3.5 - Current Uses of the Property
The site includes two parcels totaling approximately 40 acres in size and is undeveloped. The parcel is
bordered by Bennet Parkway and a church to the north, Michigan Road/US 421 to the east, and light
industrial and residential to the south and west.

3.6 - Past Uses of the Property
The following aerial photography was researched at the Hamilton County office of the Natural
Resources Conservation Service and other available aerial photography:

The site appears as two farmed parcels on all of the available aerial photography. The farmstead for the
northern parcel appears on the aerial photography through 1992. The farmstead is located along US
421/Michigan Road, just to the north of the northern parcel. Development of the surrounding parcel is
first evident on the 1971 photography with the car dealership on the northwest comer of Michigan
Road/US 421 and 106th Street just south of the subject parcels. No evidence of dumping or activities
that would adversely impact the site were noted on the aerial photographs.
3.7 - Current and Past Uses of Adioining Properties
The area surrounding the subject parcel is rapidly transitioning from agricultural to residential and
commercial use. Development consists of commercial, light industrial, and residential uses. Review of
the historical aerial photography confirms that the adjoining properties have historically been used
substantially for agricultural and residential purposes.

Section 4 - RECORDS REVIEW
4.1 - Standard Environmental Records Search
A search of nationwide and local database sources was provided for this report by First Search
Technology Corporation on August 24, 2005. That search was performed using the parameter limits
specified by ASTM Standard E 1527-2000. A copy ofthe report is included as an attachment to this site
assessment. Of the several data files searched by First Search, no site files were identified within
appropriate search radii from the subject parcel. Ten sites were identified within the appropriate zip
code but not geocoded. None of those sites appears to be within the appropriate search radius of the
subject parcels.
4.2 - Physical Setting Sources
A review of available aerial photography at the Hamilton County office of the Natural Resources
Conservation Service indicates the subject parcel has been characterized by the current use since at least
1941. Surrounding land use has historically been agricultural and has been developing into residential
and commercial as the cities of Carmel and Zionsville have grown over the previous 40 years. There is
no evidence of significant dumping or outside storage on the various sets of historic photos. The 1941
photos are the oldest photography available for the site. Similarly, there is no evidence of significant
dumping on the most recent (2004) aerials of the site.
4.3 - Historical Use Information
The subject parcel has reportedly been farm land. No other historical use information is available. The
site appears as currently developed dating back through at least the 1941 aerial photography.
4.4 - Additional Records Sources
The information discussed above presents the full extent of knowledge gained concerning the subject
tract. It represents current research into site development and land use and information gleaned from
reasonably available sources.
Section 5 - INFORMATION FROM SITE RECONNAISSANCE AND
INTERVIEWS
5.1 - Hazardous Substances in Connection with Identified Uses
There is no evidence of hazardous substances having been used, stored, or disposed of on the subject
parcels in connection with any known past or present use of the parcels.

5.2 - Hazardous Substance Containers and Unidentified Substance Containers
No hazardous substance containers or unidentified substance containers were observed during the site
investigation.
5.3 -. Storage Tanks
No above- or underground storage tanks were noted during the site visit of the subject property.
5.4 - Indications of PCBs
No indications of PCBs were noted during the site visit of the subject property. The one electric
transformer box noted on the site was indicated as non-PCB containing.
5.5 - Indications of Solid Waste Disposal
There is no evidence of solid waste disposal on the parcel. No hazardous materials were observed on
the property at the time of the site inspection. No past on-site uses have been identified that may have
included production, storage, or disposal of regulated materials.
5.6 - Physical Setting Analysis
Facilities and structures on the parcel are representative of what would reasonably be expected in
association with a fallow agricultural parcel. No features were observed that would indicate uses other
than those described herein. On the basis of the conditions observed in the field and on the historic
aerial photography, it is reasonable to believe the parcel has been used as described herein through the
past.
No nearby developments would reasonably be anticipated to generate pollutants off site that would
subsequently be transported to this parcel under reasonably anticipated conditions. Surface drainage is
generally anticipated to flow to the west toward Eagle Creek.
5.7 - Other Conditions of Concern
No other conditions were observed or reported that would adversely impact the suitability of this tract
for continued use in their existing state or for future development.
None of the site file reference locations found during the First Search review of available historic
database records have the potential to contribute significant contamination on the subject parcel.
5.8 - Site Plan
The aerial photo included with this report presents a plan view of the subject parcel.
5.9 - Compliance with ASTM Standard
This report has been prepared in compliance with ASTM Standard Practice E 1527-2000.

Section 6 - FINDINGS AND CONCLUSIONS
We have performed a Phase I Environmental Site Assessment in conformity with the scope and
limitations of ASTM Standard Practice E 1527-2000 for two parcels containing approximately 40 acres
of land in total. This investigation evaluated the parcels located at the southwest comer of Michigan
RoadlUS 421 and Bennet Parkway, Carmel, Hamilton County, and Zionsville, Boone County, Indiana.
Any exceptions to or deletions from this practice are described in Section 5.9 of this report. This
assessment has revealed no evidence of recognized environmental conditions in connection with the
parcels.

Section 8 - QUALIFICATIONS OF THE ENVIRONMENTAL PROFESSIONAL
Ms. Meador has a Bachelor of Science degree in Ecology, Ethology, and Evolution and a Bachelor of
Arts degree in Humanities from the University of Illinois at Champaign-Urbana. Additionally, Ms.
Meador has a Master's in Environmental Science from the School of Public and Environmental Affairs
- Indiana University. She has prepared environmental analysis documents since 1994 for a wide variety
of projects, including Phase I and II Environmental Site Assessments.
This report contains certain limited information regarding the subject parcel as requested by Heritage
ROO, LLC, to be used as a part of an investigation of the property and potential environmental liabilities
associated with the property. The services performed by American Consulting, Inc., under this
agreement are limited and ministerial in nature. The summaries and findings of this report describe only
those conditions that appeared to be present at the time of our study.
It should be noted that environmental evaluations are inherently limited in the sense that conclusions are
drawn and opinions are rendered from information obtained from limited research and site investigation.
For these types of evaluations, it is often necessary to use information prepared by others, and American
Consulting, Inc. cannot be responsible for the accuracy of such information. Additionally, the passage
of time may result in a change in the environmental characteristics at this site and on surrounding
properties. This report does not warrant against conditions present of a type or at a location not

investigated. This report is not a regulatory compliance audit and IS not intended to satisfy the
requirements of any state, federal, or local real estate transfer laws.
Subsurface conditions were not field investigated, as that was outside the scope of this study, and may
differ from the conditions implied by surficial observations. This study is not intended to assess or
otherwise determine whether soil impacts, waste emplacement, or groundwater impacts exist. These
data are accessible only by subsurface material and groundwater sampling through the completion of
soil borings and the installation of monitoring wells. The scope of work, in accordance with our
Agreement, did not include these activities. No investigation into mining maps or records has been
made.
Other conditions may exist in inaccessible areas or be discussed in documents not reviewed. Therefore,
this study does not eliminate the possibility unobserved and/or undocumented environmental conditions,
which may affect the economic viability of the site, could be present. This study does not address the
possible presence of environmental contaminants under the ground surface or in areas that were not
accessible at the time of the site visit. Accordingly, American Consulting's liability for any matter in
connection with this report is limited in accordance with terms of our Agreement for the preparation of
this report. This report is for the sole use of Heritage RDG, LLC, and Wal-Mart and may not be used or
relied upon by any person or entity not party to the agreement between the Heritage RDG, LLC, and
American Consulting, Inc., without written permission of both parties.

NCDB: National C~liance Database. The National Compliance Data Base
System (NCDB) tracks regional compliance and enforcement activity and
manages the Pesticides and Toxic Substances Compliance and Enforcement
