Here is a scanned copy of the info packet that will be sent to each board member. Again, the copying fees will be
a total of $2.70. Also, the total application fees will be: $2,163.00. Separate checks, made out to The City of
Carmel, for each would be appreciated, since they go to different funds.
Remember, a representative for the petitioner must be present and speak at the meeting April 24, 6 pm.
Unfortunately, I will not be here next week, so if you have questions, you can ask Connie Tingley, the BZA
secretary, or Matt Griffin, Planning Administrator.

This parking lot expansion does not currently have any negative effect on the
neighborhood. The church is willing to take appropriate measures, such as digging a
ditch, should any negative effects &om the parking lot be found.
The lot expansion allows church members to park in the church lot rather than on
the street.

We will have to continue this again. The difficulty at this point seems to be that church's engineer is
very busy and he has not been able to meet with everyone the T AC asked him to meet with before the

From reading the T AC minutes, it looks like Mike McBride, Greg Hoyes, and Scott Brewer have
requested information from the church. These are the people we'll plan to meet with before next month.

similar to the findings of fact. You are tying to prove your hardship, in a way.
The statement of variance is just a statement listing the variances you are requesting. You can even compare

Well, the committee will make sure that the parking lot was built correctly, with the property drainage and proper
pavement specifications.
They will also check to see if the paved area is within an easement or a legal drain.

A landscape plan is important for this petition, so that will definitely have to be submitted.

Dear Mr. Flora:
The Hamilton County Surveyor's Office has received your TAC submittal for the above
named project on November 8, 2005. While you may apply for the after-the-fact variances
from the Cmnel Planning Commission, these variances do not negate any jurisdiction or
requirements by the Hamilton County Drainage Board and Surveyor's Office.
A Notice of Violation was sent to the property owner of record on November 17,2004 and a
copy is also attached to this letter. The notice was based on Hamilton County Ordinance
4-26-99-C(7)b, which requires. staged detention be provided when improvements are made to
any property located within a regulated drain watershed. This proposed project lies within
the Richard Moffitt Regulated Drain Watershed and is known to have existing drainage
problems. Alsot sub-section 5 of the same ordinances requires downstream improvements
when an adequate outlet is not located on-site. as in this case.
The Hamilton County Surveyor's Office would like to see plans on how the additional stonn
water runoff will be addressed without negatively impacting the limited resourees of the
regulated. drain and the SUD'Ouncling property owners. Any request for variance from the
above named ordinance will need to be requested from the Hamilton County Drainase Board.
The written request will need to be received by the Hamilton County Surveyor's Office by
noon on the first or third Monday of the month. as the meetings are on the second and forth
Monday of every month. The Drainage Board has previously discussed this project

This Office has inspected this site and has observed the following:
1. Work altering drainage patterns has occurred within the Richard Moffit Regulated
Drain Shed. This work commenced without the written authorization of the
Hamilton County Surveyor's Office OT the Hamilton County Drainage Board.
2. The work done on the Church's parcel involved the creation of significant new
impervious surfaces with the construction of a parking lot. Doing so without
providing adequate detention is prohibited by Hamilton County Ordinance. Please
copies of the pertinent ordinance enclosed.
Upon receipt of this letter, ten (10) days are given to correct the Violation according to
the standards set forth by this Office and The Hamilton County Drainage Board. To
correct the Violation. a plan must be submitted that will deoict an area providing for

This letter is being provided to inform you that it has recently been brought to the ~
City's attention that a parking lot at 800 110th St. E, a property listed under your ~.
ownership, has been created without Plan Commission approval. This property is ~ ~
zoned R3, a residential district. As per ~23E.04 & 23E.07 of the Carmel Zoning"
Ordinance the creation of the parking lot requires approval from the City of
Carmel. Additionally, the parking area shall be curbed, landscaped and proper
drainage achieved. Enclosed please find the sections of the Ordinance that
pertain to this issue.
Please contact Jon Dobosiewicz, Planning Administrator, at (317) 571-2417 for
more information and the process for applying for the Special Use Amendment.
Please either remove the new asp halted parking lot or apply for a Special Use
Amendment by June 31, 2005. Failure to comply will result in a lawsuit being filed
and seeking relief in court. If you have any questions or comments regarding this
