The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: D the subiect orooerty will be better landscaoed and orovide better oedestrian access than if there were sianificant develooment close to Michiaan Road. and the overall desian of the site from a traffic f1ow/oarkina oersoective is enhanced bv the arantina of the variance. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: u the orooerties adiacent to the subiect orooerty. which are all zoned B-3. will be well screened by the landscaoina on the subiect orooerty. and the subiect orooerty also orovides ootential connectivity to the north and south adioiners. which will enhance the value of said orooerties. u 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: u the subiect orooerty is narrow (692' -728') and deeD (1340' -1570'), and is also subiect to the Town of Zionsville Michiaan Road Overlay Ordinance. The develooment standards of the two Overlay Ordinances. (Carmel and Zionsville). includina the reauirement in the Zionsville Ordinance that all buildinas must face Michiaan Road. renders it difficult to develoo the subiect orooerty with a maximum setback of 120 feet. which is less than 10% of the deoth of the subject orooerty. Not all develooment standards of the Carmel Michiaan Road Overlay Ordinance can be met. even if a minimum size orincioal buildina was erected on the subiect orooerty and met the maximum front yard reauirement. u u u u DECISION IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance Docket No. is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof. STATEMENT OF SUPPORT DOCKET NO.: 06030013V Petitioner proposes a single use development on approximately 22.43 acres, located partially in Hamilton County (7.88 acres) and partially in Boone County (14.55 acres). The subject property is significantly deep and is subject to two zoning ordinances and two overlay zones. After responding to numerous comments from both jurisdictions, the site plan evolved so that no "front outlot" could be created. The Zionsville Overlay Ordinance requires all buildings to face Michigan Road, resulting in the application ofthe maximum front yard requirement of 120 feet (with a minimum front greenbelt of 30 feet severely reducing development by effectively limiting a parking field to less than 50 feet of depth. The Petitioner proposes to mitigate the front yard requirement by placing a gazebo building tied to the pedestrian walkways being constructed within the 120 foot front yard. Refers to the physical arrangement of Dwelling Units such as a detached Single-family Dwelling, cluster Single-family Dwelling, duplex or Two-family Dwelling, Row House or Multiple-family Dwelling.STUDIO, RADIO &/OR TELEVISION. Space in an outdoor or indoor area, building, part of a building, structure, or defined area, that is used primarily for the creation offilm, television, music video, multi-media, or other related activities. ~ D SUBDIVISION. Any of the following shall be considered the subdivision of land requiring plat approval by the Plan Commission: " I. The division of any parcel of land (recorded after January 21, 1980, and before January 1,2000) into three (3) or more parcels, sites or Lots, when more than two (2) of the Lots are less than five (5) acres in area, for the purpose of transfer of ownership, or building development, excluding cemeteries; or, The improvement (before January 1, 2000) of one (1) or more parcels of land for residential, commercial or .industrial structures or groups of structures involving the subdivision and allocation of land as streets or other open spaces for common use by owners, occupants or lease holders or as easements for the extension and maintenance of pubric sewer, water, storm drainage, or other public utilities and facilities; or, . - 2.
