PROJECT INTRODUCTION:
At our private residence we plan to install a small in -ground pool and hot tub built by Above and Beyond. The pool will
be 14 x 26 foot with a 10 x 10 hot tub beginning where the pool ends. The pool will be surrounded by a concrete pad
leaving at least 3 f eet of clearance as needed for the design. The rear of our property will have a beautiful steel wall with
trees to offer privacy for our neighbors. The design will include an accessory building offering shade from the sun, which
will encroach into our side yard to the North. This structure will be surrounded by trees offering privacy from the street
and our neighbors.
STATEMENT OF VARIANCE REQUESTED:
Requesting variance for PUD ordinance Z -465-01, section 6.1-Accessory buildings and swimming pools must be located
behind primary structure; pool house and pool to encroach 38.5’ north of house into side yard.
PUD ordinance Z-465-04, section 6.1-Accessory structures and swimming pools must be 3 feet off easement; 0 feet
requested.
STATEMENT OF SUPPORT:
We are seeking support toward this project because it will improve our family’s quality of life by joining multiple
generations. In our forever home, we look forward to providing an oasis for our family as well as getting to know our
neighbors in a fun and relaxing atmosphere. This project will promote family time and togetherness while allowing for
physical activity at home with our kids. We look forward to bonding with our neighbors who have recently been there
for us immensely, through a devastating tragedy. We look forward to the approval of this proposal as it will also add
value to our properties in The Village of West Clay neighborhood.

The request for the variance on this private property will not be a public health or safety concern. The project will not affect
the morals or general welfare of the community due to its professional installation, design and quality materials used.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially
adverse manner because:
The project placement and professional design with quality equipment will not adversely affect the adjacent properties.
Instead, it will offer more privacy for all and will be visually appealing at all angles of the space.
3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the
use of the property because:
Based on the d rainage and utility easement as well as lot coverage ratios, variances are required for improvements and
safe maneuverability around the pool.

IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No.
___________________________ is granted, subject to any conditions stated in the minutes of this Board, which are
incorporated herein by reference and made a part hereof.
