responsible for monitoring Severe weather and making sure
no persons are allowed under the tent with winds exceeding
30 MPH, or during extreme Rain, Snow, Wind Storm &
Thunder, and Lightning. Ace Party Rental will not be held
responsible for any damage done to personal property, or
persons, under or around the tent due to a collapsing tent
brought on by any weather conditions listed above . You
will be held responsible if there is any damage done to Ace
Party Rental property listed on the invoice due to neglect of
taking care of these items while in your possession. You will
be charged to replace any items that have been ruined due

Equipment Protection Plan
Equipment Protection Plan Details
Our clients have the option to accept Ace’s Equipment
Protection Plan. If Customer accepts the Equipment
Protection Plan, then Ace charges an additional 10% of your
product total and waives all claims against the client for
accidental breakage or damage to Rental Items, with the
exception of third-party sub rental items, that occurs
despite usage and handling with reasonable care. If the
client chooses not to accept Ace's Equipment Protection
Plan then they must provide a Copy Of Insurance (COI)
either from an existing home owners or business policy or
from purchasing temporary event insurance from a licensed
broker showing proof that Ace Party Rental has been added
to the policy as a covered member.
Items not returned to Ace within seven (7) days after your
event are billed the full replacement cost. Speak with your
Ace event consultant to learn more.
The Equipment Protection Plan is not insurance and it does
not cover:
Rental items not returned
Theft
Damage resulting from vandalism or intentional or
improper misuse
Damage resulting from failure to secure Rental Items during
transport, overloading or exceeding the rated capacity of
the Rental Items
Damage to motors or other electrical appliances or devices
caused by artificial current
Any damage resulting from overturning
Any damage resulting from use of the Rental Items in
violation of any provision of this Agreement or violation of
any law, ordinance or regulation
Any damage due to weather
Any Damage to third party sub rental items or specialty
linens

Underground 811
811 Confirmation is required by Indiana State Code before
Ace is able to stake or dig in any location (stakes range in
depth from 36" to 42").
Customer agrees to call 811 the week before the event date
to have all underground utilities in the vicinity of the Tent or
Inflatable clearly marked. Customer must send the 811
confirmation number to Marleigha at
Leigha@aceitindy.com.
Marleigha must have the 811 confirmation number 5
business days before your event or the Friday before by 3
pm. If Marleigha does not have the confirmation number
there will be a $100.00 fee applied for Ace to make the call.
In email, please include satellite image with tent or
inflatable location marked on property (or have the 4
corners marked when the crew arrives). If neither step is
taken, the tent will be set up at crew's discretion.

Delivery
Delivery is noted in the Order Description and is shown at
the top of this email. Delivery is Thursday or Friday and pick
up is Monday or Tuesday unless otherwise noted. The
delivery day and time can only be changed by the office.
Additional fees apply for stairs, hills and obstructed
pathways. It is the customer's responsibility to test all
equipment and machinery before his or her event. In order
for any refunds to be given Ace must be notified of (and
given the chance to correct) any issues via email at

Terms and Conditions of Rental
Ace Your Event Indy, LLC
PHYSICAL CONDITON OF RENTAL ITEM(S)
You acknowledge that prior to taking the rental item(s), you examined it, saw it in operation (if appropriate) and are aware of its
condition and that it is in good condition except for any defect noted on this contract. It is your responsibility to return the rented
item(s) to Ace Your Event Indy, LLC in the same condition, except for ordinary wear and tear.
USE OF THE ITEM(S)
You agree that you are satisfied with the instruction given by Ace Your Event Indy, LLC in the proper and safe manner of using
the item(s) or that you are so familiar and told Ace Your Event Indy, LLC that you were. You further agree that the item(s) will be
used only at the address designated and only for that purpose for which the item(s) was manufactured and intended. Subleasing
or improper use is prohibited. You have read and understand all manuals, written operating instructions and warnings as
supplied for the equipment.
RESPONSIBILITY FOR USE AND DISCLAIMER OF WARRANTEES
You are responsible for the use of the rented item(s). You assume all risk inherent in the operation and use of the item(s) and
agree to assume the entire responsibility for the defense of and to pay, indemnify and hold Ace Your Event Indy, LLC harmless
from, and hereby release Ace Your Event Indy, LLC from any and all claims for damage to property or bodily injury (including
death) resulting from the use, operation or possession of the item(s), whether or not it be claimed or found that such damage or
injury resulted in whole or in part from Ace Your Event Indy, LLC negligence, from the defective condition of the item(s) or from
any cause. YOU AGREE THAT NO WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A
PARTICULAR PURPOSE HAVE BEEN MADE IN CONNECTION WITH THE EQUIPMENT RENTED.
RESPONSIBILITY FOR EQUIPMENT
From the time the item(s) is rented out until it is returned, you are responsible for it. If the item(s) is lost, stolen or damaged
under any circumstances while rented, regardless of fault, In Ace Your Event Indy, LLC, in addition to any other remedy available
to it either under the law, or by virtue of this Contract, in its discretion, either shall have the right to hold you responsible for all
charges, including labor costs, to repair the item(s), or shall have the right, including labor costs to seek from you the cost of
replacing the item(s). If the item(s) is returned not clean, a cleaning charge will be imposed. FAILURE TO RETURN RENTED
PROPERTY UNDER THE TERMS OF THIS CONTRCT MAY SUBJECT THE RENTER TO CRIMINAL PROSECUTION.
ITEM(S) FAILURE
You agree immediately to discontinue the attempt to use the rented item(s) should it at any time become unsafe or in a state of
disrepair and will immediately (one hour or less) notify Ace Your Event Indy, LLC of the facts. Ace Your Event Indy, LLC agrees in
its discretion to make the item(s) operable within a reasonable time or provide you with a like item if available, or make a like
item available at another time or adjust the rental charges. This provision does not relieve you from the obligations imposed by
other paragraphs. In all events, Ace Your Event Indy, LLC shall not be responsible for any injury or damage, including
consequential damage, resulting from failure or defect of a rented item(s).
RETURN OF ITEMS
The rented item(s) is Ace Your Event Indy, LLC property and is rented to you subject to this contract for rental charges and for
the period of time noted on the reverse side. If you desire to extend the term of this rental beyond the time and date specified
on the reverse side under “Due”, you must immediately notify Ace Your Event Indy, LLC to obtain our approval, the terms for
such extension and a modification of this contract. If this agreement has not been extended and you fail to return the item(s)
when due in, Indiana . Ace Your Event Indy, LLC to enforce its property ownership of the item(s) and to protect its interest |
under this contract may retake the item(s) at any time and to do so, Ace Your Event Indy, LLC or it’s representatives may enter
your property and you hereby waive any right of action against Ace Your Event Indy, LLC for such entry and retaking. In addition
you acknowledge that the failure to return rented item(s) within the contract and the sale or concealment of returned item(s) are
prohibited and that such action may constitute a crime. Ace Your Event Indy, LLC, in addition to any other action we may take,
may notify the authorities and take other action, including the filing of criminal complaints, subjecting you to prosecution.
CHARGES AND PAYMENTS
Deposit is to guarantee the rental of said items for event date. Deposit will be credited to balance due at time of rental. Deposit
(value) of 50% of rental total is non-refundable. Additionally all tent rentals must be canceled 2 weeks prior to the event date or
you will be billed for the price of the tent. Time is money. You are responsible for rental charges from the time the item(s) is
“out” as specified on the reverse side until it is returned and other charges hereunder. Return the item(s) promptly, clean and in
good condition. You and your representative, agent or principal shall be responsible for and shall pay Ace Your Event Indy, LLC
all charges hereunder. All charges are due upon return of the item(s) and on demand. If the rental charges are charged to
someone other than the Renter, the Renter represents he/she is the agent of such party and has the right to charge this rental;
the other obligations and responsibilities of the Renter hereunder. If rental charges are not paid within 10 days of their due date,
Indiana Wedding Decorators, at is discretion, may recalculate all charges on a daily rental rate basis.
COLLECTION COSTS AND REMEDIES
You agree to pay attorney fees, collection fees, court costs and any other expenses incurred in collecting any charges under this
agreement, in retaking the rental item(s) or otherwise in enforcing the terms of this contract. You further agree that Ace Your
Event Indy, LLC may avail itself of any remedy allowed by law to secure and collect all amounts that may be due hereunder. In

MODIFICATION OF CONTRACT
This paper represents our entire contract and there are no collateral, oral or other agreements outstanding. None of Ace Your
Event Indy, LLC rights may be changed and no extension of the term of this contract may be made except in writing signed by
Ace Your Event Indy, LLC and made a part of this contract.
DAMAGE WAIVER
If you pay the damage waiver charge (DWC) as specified, subject to the limitations and exclusions below, Ace Your Event Indy,
LLC agrees to modify the terms of this contract and relieve you of liability for accidental damage to the rented item(s) on this
contract and for loss due to fire, windstorm, upset and riot. We exclude from the waiver, however, any loss or damage due to
theft, burglary, collision, misuse or abuse, theft by conversion, intentional damage, mysterious disappearance or any loss due to
your failure to care for the rental item(s) as a prudent person would his/her own property, such as proper lubrication. In addition,
if the item(s) rented is a truck, you are not relieved of liability of accidental damage for the truck container (box) caused by
striking a stationary object. If any such loss tends to indicate a crime may have been committed, a further condition of this
waiver is that you must file a report to the proper law enforcement authorities and furnish us a copy. In addition, if you have
insurance for the loss or damage, you shall exercise and shall empower us to exercise all your rights to obtain recovery under
insurance, shall cooperate with Ace Your Event Indy, LLC to obtain recovery and all insurance proceeds shall be given or
assigned to Ace Your Event Indy, LLC
Payment Policy
A 50.00% deposit is required to confirm your contract and full payment will be due 14 days prior to delivery/pickup/install.
Additional fees will apply for credit card and e-check/ACH payments.
General Cancellation Policy
To ensure availability of all services and products, deposits are non-refundable. You may remove one or more item(s) from your
order, or cancel your entire order, according to the following schedule, but the following cancellation fees will apply, subject to
any category-specific cancellation policies:
15 days prior: no cancellation fee
14 days prior: 0% of contract total, less deposit (if refundable)
Days prior refers to the number of days before the earliest delivery/pickup/setup/arrival time.
