r The regular meeting of the Carmel Plan Commission was called to order by
the president, Richard Albright, at 7:35 P.M. July 21, 1987 at the City Meet.
ing Hall. The meeting opened with the Pledge of Allegiance.
Roll was called and all members were present as follows: Richard Albright
Sue McMullen, Jim O'Neal-, Sr., Vaughn Story, Henrietta Lamb, Paul Ayers, Ila
Badger, Max Moore, Minnie Doane, Jeff Davis, Sandra Long, Bob Boone and Jim
— Schneider.
Staff members present were: Gordon Byers, Chuck Kiphart and Rosalind
McCart. ,
There were no additions or corrections to the minutes of the June 16, 198r
meeting and Mr. O'Neal moved that they be approved as submitted.
Seconded by Mrs. Badger.
Motion carried.
Mrs. McMullen related that the City Council did act on the ordinances (in-
cluding the cul-de-sac ordinance) and did approve them.
Mr. Albright spoke of a letter dated June 22, 1987 from Mayor Reiman re-
garding Carmel Dr. sidewalks (which is a part of the official minutes and
attached to the master copy). Mayor Reiman related that she had instructed
the city engineer in May to notify the property owners on Carmel Dr. to put i
their sidewalks.
Mr. Albright said he received a letter from Coppergate Subdivision develoF
er, R.J. Klein, stating that he was concerned about the mention of his sub-
division by Tom Schellenberger concerning the installation of septic systems
on those lots. Mr. Klein sent Mr. Albright a copy of a report prepared by a
PHD Soil Scientist from the Dept. of Agronomy at Purdue Univ. (which is in th
file in the Dept. of Community Development) who had studied the soils as they
exist today in that subdivision and who suggested several ways of handling th
situation. A lot by lot report was included suggesting where on the lots the
septic should go and the recommended system to use.
A letter from the Hamilton County Health Dept. was read by Mr. Albright
(which is a part of the official minutes and attached'to the master copy)
-- stating that effective July 17, 1987 the Hamilton County Board of Health re-
quires that a soils evaluation be conducted by a soil scientist who is accept
able to the Board of Health on all subdivision plats in Hamilton County.
G. Public Hearings
19. 7:30 P.M., Public Hearing on Docket No. 49-87 D.P. Development Plan
Application for a 2,900 sq. ft. addition to the existing Stewart Law
Office. Site is zoned B-7 and located at 931 S. Range Line Rd..in
Carmel, IN. (BZA Variance required).
Filed by Phillip L. Stewart.
The public hearing opened at 7:45 with Mr. Stewart making the presentation
for a 2900 sq. ft. addition to his property. The plan was shown and explaine,
for the 40 ft. wide by 70 ft. long expansion, with a basement level for storal
for law offices. 'The total sq. ft. of the building with the addition will be

There are 10 parking spaces presently and 12 additional are proposed.
Three variances from the Board of Zoning Appeals are required.
Color photos of the existing structure and an elevation drawing were passe(
to members.
An exterior drawing of the building was shown.
Building materials that blend with the existing structure will be used.
All parking areas will be curbed.
Mayor Jane Reiman was present and"spoke of B-7 zoning and its origin. stat-
ing that the intent of the B-7 is'to protect the residential areas to the east
and that Mr, Stewart request this evening will not protect those to the east
Mayor Reiman said she objects because it is a major change in the B-7 zone,
Mr. Stewart responded assuring that the neighbors are fully aware of these
plans and that he has talked with them about it. Mr. Stewart. said the neigh-
bors approve of what he has done so far and are not opposed to the proposal,

The public hearing closed at 8:00.
Mr. Stewart informed that. the parking proposed is only to meet the ordin-
ance. They anticipate4,aO, people in the office and'they do not need all the
spaces required by ordinance. Mr. Stewartsaid they could have a green belt
on the east side by g1'v3iig up seven parking' spaces. i

ibe replacing trees on the south property line.

2g. 7:30 P.M., Public Hearing on Docket No. 59-87 Z, Rezone Application fa
68.568 acres of land located at S.E. corner of 116th St. and Spring
Mill Rd. Petitioner requests a change from the existing S-2 zoning tc
B-6 zoning for a proposed multi -building office complex. Petitioner
Illf also commits to certain covenants and conditions as part of the rezone
request.

Dr. and Mrs. John Pittman, Al Oak of Paul I.• Cripe, Inc., Moe Thomas of
Thomas`Assoc. and John Meir, HNTB (Traffic Consultants) were present.
The public hearing opened at 8:07 with Mr. Nelson making the presentation.
Location and surrounding uses were presented and an aerial photo was shown
Mr. Nelson stated that ttiis property is on the fringe of the Meridian
Corridor and next to high rise buildings and will not be appropriately develo
ed as residential. It is a transitional area and the petitioner requests to
develop the parcel as an office park to be known as Spring Mill Center. The
height of the buildings is to be restricted.
An enlargement of the recommended Land Use Map was shown to point out this
transitional area.
The conceptual development plan was presented and it is to be developed
into 4 parcels. Parcel A is 20.2 acres abutting Fidelity Plaza and the
Meridian Corridor. The use will be restricted to office use in a five story
building 80 ft. in height. Parcel B fronts on Spring Mill Rd, and will be for office use in a three story building not to exceed 45 ft. in height. -The
parcel will contain a lake near Spring Mill Rd. Parcel C abuts lllth Street
to the south and will be for a one story office use. The parcel will contain
a retention pond. Parcel D will be a 100 ft. landscape mound that will run
the entire length of the north, west and south sides. This green belt contaij
9.5 acres or 14o of the available acreage.
There will be earth mounds and landscaping along the main boulevard and at
the entrances and these improvements will be installed prior to the first
certificate of occupancy for the first office building.
There will be Indianapolis water and road improvements to the entrances on
116th and lllth Streets have been approved by Mr. Hufford.
The collector street within the perimeter of the property will be. 26 ft.
wide (per lane) and will be dual lane at the entrance.
Concerning commitments and covenants, Dr. Pittman covenanted that certain
excluded uses in the Overlay Zone apply to this parcel, the site development
approval will be subject to continuing jurisdiction of the Carmel Plan Com-
mission, the use of the real estate will be restricted to office and parcel D
will remain as a permanent green belt.
Mr.. Nelson stated that this proposal is the most appropriate use for this
real estate and provides an element of transition.
Prepared reports regarding the project were passed to members to review.
Mayor Jane Reiman made comments, stating that she is neither for or agains'f
the proposal at this time but asked the petitioner and Plan Commission mem-
bers to give consideration to the very important matter of the building and
improvement of the roads and the intersection of 116th St. and Spring Mill Rd,
i! Mayor Reiman urged that 116th St. be widened to 4 lanes and that Spring Mill
Rd. and 116th St. be studied and upgraded, stating that traffic and roads are
a priority and she feels the petitioner should pay for these improvements.

Mayor Reiman related that over the years other petitioners have built roads,
etc., as part of their initial plan and that we must not compromise.
Bob Book, 12550 Spring Mill Rd., representing Clay West Property Owners
Assn., spoke in opposition to bringing commercial to Spring Mill Rd. Mr.
Book stated that the corridor was done in such a way that property owners on
each side are protected over a long period of time and urged the Commission
_- to keep faith in the Comprehensive Plan.
Earl Schleicher, 11 W. lllth St., spoke in opposition, stating that there
is a major traffic problem now in trying to get out onto Meridian from lllth
St., that lllth St, is not wide enough to allow for this additional traffic
and that there is already a drainage problem.
Marvin Klingman, just south of Schleicher's property, said that the corric
is already commercial against their wishes and asked why can't we keep Sprinh
Mill residential all the way up. Mr. Klingman stated that lllth St, would
have to be widened and a stop light would be needed at lllth and U.S. 31.
Mr. Doug Church, Noblesville attorney, representing the Frenzels and the
Bookwalters on Spring Mill Rd., made a presentation in opposition to this re-
zone stating that rezoning from residential to commercial is the most radical
and urged the Commission to stop putting commercial in noncommercial areas.
Mr. Church said the reason for this intrusion into residential is that the
Property owner will personally profit from this investment and asked that the
existing zoning classification be kept.
Chuck Wilson, attorney at Box 82001, One Indiana Square,,Indianapolis, IN.
representing the people south of lllth St. and east of Spring Mill Rd., made
a presentation stating that there is no commercial development on Spring Mill
Rd. at this time and they are very concerned about this proposed commercial
development. '
Mr. Wilson said he is confused as to who the petitioner is and asked Mr.
Byers to look into who is the correct petitioner in this case.
Mr. Wilson questioned if the purpose and intent of the B-6 District'is to
include properties that are bounded by lllth St., 116th St. and Spring'Mill
..-Rd., all of which are in an inappropriate condition for this kind of a dev-
elopment.
.Mr. Wilson stated that there is nothing in the covenants that has anything
to do with the road problems and asked that the Commission deny this request
for a rezone.
Richard Strain, Spring Mill Streams Homeowners' Assn., urged the Plan Com-
mission to vote against this rezone and keep Spring Mill Rd. a buffer resi-
dential zone.
Wally Boysen, 10989 Spring Mill In., spoke of the increasing traffic on
Spring Mill now and said that this is of great concern.
Jeanne Book, 12550 Spring Mill Rd., asked to keep Spring Mill completely
residential and urged the petitioner to go back to the drawing board.
Gary Schnitz, 11088 Spring Mill In., spoke in opposition.
Dick McKenna, 11070 Spring Mill In., stated concern for the protection of
the Carmel community neighborhoods and urged the Commission to vote against
the rezone and protect our neighborhoods.
Peg Goldberg, 12800 Shelbourne Rd., Clay West Property Owners Assn., and
a Hamilton County Commissioner, urged the Commission to vote NO on behalf of
the County Commissioners. Mrs. Goldberg said the roads will not handle this
additional traffic and the detention -retention ponds are not a long range
solution to poor soils and drainage problems. Mrs. Goldberg said also that
more police protection would be needed and that she believes the original:
Plan of residential along Spring Mill Rd. should be honored.
Sue Dillon, Spring Mill Streams., said that commercial use would have,a
domino effect and that she feels threatened by commercial development along
Spring Mill Rd.
Robert Roberto, 321 W. 107th St., stated concern for traffic and the safety
of their children and families along that area.

Sam and Lucina Moxley, 11612 Wm. Creek Dr., were read by Mr. Albright and
introduced into the record. These letters are a part of the official min-

Mr. Nelson made responding remarks commenting*on the Comprehensive Plan
and stating that they`'a're aware of the traffic and its study and the con-

Mr. Ayers questioned the plan for the school property across the road on
Spring Mill Rd.
Mr. O'Neal answered that there are no current plans for the 80 acres
owned by the school, which was originally purchased for a second high school
Mrs. McMullen commented regarding sidewalks in Clay Twp., relating"that
the county has said NO to sidewalks in Clay Twp.
This item was sent to the Technical Advisory Committee for review on
Thursday, July 23 at 10:30 A.M. and to the Land Use Committee for August 4,
1987 at the City Meeting Hall.

erate funds for the increase of two staff members for Mr. Kiphart's office,
fees need to be increased and the Executive Committee is to review this
matter.
