The meeting opened with the Pledge of Allegiance: -:11. Roll was called and members present were: Jeff Davis, Sue•McMullen'(arriv ed 8:45), Paul Ayers (arrived 8:15), Minnie Doane, Bob Boone, Ila Badger, Jim O'Neal, Sr., Vaughn Story, Henrietta Lamb and Jim Schneider. Absent were: -- Richard Albright, Sandra Long and Max Moore. J. Staff members in attendance were: Chuck Kiphart, David Cunningham, Gordon Byers and Rosalind McCart.. i. - There were no additions or corrections to the minutes<.of the July 27,, 1987 meeting and Mr. Story moved that they be approved as submitted. Public Hearings 19• 7:30 P.M., Public Hearing on Docket Not 68-87)P.V „ Plat Vacation re- quest for a portion of College Park Subdivision, located east of Penn- sylvania St., west of College, south of I-465 and north of 96th St. Petitioner requests the vacation of 316 lots of the 656 original' platted lots. Site is zoned S-2 and is located in Clay Twp. Filed by Phillip Nicely, Attorney for Duke Realty Corp. The public hearing opened at 7:35 with Mr. Nicely making the presentation for plat vacation. An aerial photo was shown to acres involved. Point out location of the approximately 65 This area was platted in 1922 for single family residential on very small lots. The plat as it was originally intended was shown. It has been undo hoped since 1922. The interstate 465 now bisects the plat and it is in transitional area F. Commercial Land Use, in the Carmel -Clay Comprehensive Plan, All but 8 lots south of I-465 have been purchased by Duke with the idea of vacating and later to rezone the land according to.the Comprehensive Plan. With the 8 lot exception, all lots were owned by the same person (aEtrust- ee) and were acquired -within the last six months and were not purchased'with the idea of single family residences on the lots. Access to those lots was presented and the road plan for access was°shown. The petitioner is not requesting any vacation of the Clara Knotts Drain that runs through the property, Frank Marcella, 9507 Washington Blvd.. College Park, said he lives on one of these .lots on the south and related that there are some residences in that area now. Audrey Grossman, 9506 Washington Blvd. (on the south) stated that they are not opposed to the plat vacation but that they are opposed to the rezoning in the fashion that Mr. Nicely has indicated for that area. Mrs. Grossman said there is nothing there to preclude residential use here and that this will have an enormous impact on their property values. -Mrs. Grossman"stated that commercial use is not the only possible'development here and does not want" residential development precluded. Mary Ann Glancy, 324 E. 96th St., stated that no one has built a house back there because it is low and drainage is bad. Mrs. Glancy said she'rfeels office buildings there are appropriate and related that much of the land has —_been used as a dump by Marion County residents. Ed Trumpy, 9221 N. Delaware, stated that water is one of their main con- cerns and wants to see the area there residential. Mr. Trumpy said traffic is also a concern and he feels commercial development would be out of line with the neighborhood. 13tbARMEL PLAN COMMISSION MINUTES - AUGUST 18, 1987 pagei4 Paula Allan, 9575 N. Delaware, said there are a lot of office buildings . with empty space and additional office space in the area there may not be needed. Mrs. Allan said.,,that notificationi,ta�property owners did not happen Mr. Byers, Commission attorney; informed that the only issue tonight is whether the plat is to be vacated. Lynn Willis, 755 E. 96th St., expressed opposition to replatting stating that the lots can be combined, and can be built on, and people do 'live in ` this area. Mr. Willis said there is privacy in this area and the arguments that Duke has presented do not convince him that this plat vacation is necessary. Mr. Willis said a better plan for development should be brought, forward. Irvin Gully, 9740 Washington Blvd., stated that water and the water table has been a problem there for years and that water brings mosquitoes. Mr. Gully sai.d,also that the roads that were put in have not been maintained and are closed off with trash etc. Mr. Gully said he recommends the plat vaca- tion. Mr. Davis read letters in opposition (which are a part of the official minutes and attached to the master copy) from Mr. and Mrs. Donald Edwards,. 9146 N. Central, Mrs. R.L. White, 9155 N. Central and Willa -Bowen Brunt, 9156 N. Central. Mr. Nicely responded stating that they would be willing to meet with the neighborhood people to discuss their concerns. Filed by Steve Brown, Attorney for the Marriott Corp. 39. 7:30 P.M., Public Hearing on Docket No. 70-87 D.P., Preliminary Dev- elopment Plan Application for site in the U.S. 31 (Meridian St.) Cor- ridor Overlay Zone. Development plan is for a 5.0 acre site located at the S.W. corner of 103rd St. (proposed) and U.S. 31 (Meridian St.) to be used for a proposed 4 story hotel. Filed by Steve Brown, Attorney for the Marriott Corp. The public.hearing opened at 8:26 with Steve Brown, attorney with Church, Roberts and Beerbower, making the presentation.on Docket No. 69-87 Z. Notice requirements have been met. An aerial photo was shown to point Out location and surrounding land use. Proposed for the tract is the 8 to 10 million dollar Courtyard by Marriott Hotel with 149 guest rooms and suites. The sewer plan for the tract was shown. Water will be provided by the Indianapolis Water Company. The conceptual drainage plan was presented. An artists rendering was shown of the 4 story facility with swimming pool attached, all built around a landscaped courtyard. Betty Hawkins, 10240 N. Delaware, president of Northridge Neighborhood Assn expressed opposition to the hotel going.in stating that traffic is a major con cern and that there are going to be too many motels in the area. Mrs. Hawkins said this hotel does not conform to U.S. 31 Corridor Overlay intent as it does not fit the specifications as described in the 31 Overlay Zone. The public hearing closed at 8:.44 on Docket No. 69-87 Z. Traffic signalization at 103rd St. will need to be studied more thoroughly by the petitioner. �'. Elevation drawings were looked at in -detail. -- There will be brick'on the single story structure with stucco on the high rise facility. The 4 story structure will be L shaped. The -site plan was shown and explained. l There will be a 30 ft- landscape buffer along the eastern edge of the property. 103rd Street will be extended to the west (a 4 lane road). to Parking was presented. 160 spaces are proposed and they do have capacity, expandparking if needed. The refuse area was shown. It will be screened and gated.. The mechanical units on the roof will be properly screened and not visible from the street. There will be a satellite dish to the S.W. of the structure. •It will be beige in color and landscaped. The landscape, lighting and drainage plans were presented. The signage plan was explained. Primary Plat,Appli- cation:for Wood Park Subdivision consisting of 93 lots on 31.2 acres. Site is zoned R-1 and located south of 116th St. and east of College Ave. behind Hamilton Woods Subdivision in Clay Twp. Filed by Dean Ziegler for Davis Development Corp. j! The public hearing opened at 9:10 with Jim Nelson making the -presentation for a residential subdivision with 93 home sites. An artist's rendering of the Primary Plat and Development Plan were present- ed. The streets are to be 36 ft. wide with a 26 ft. wide cul-de-sac. The density allowed by ordinance is 3.5 units per acre and 2.974 units per acre are proposed. There will be 3 lakes and sidewalks within the project and along 116th St.. The petitioner plans to preserve certain existing vegitation. 11 Mounding and new plant material will be established along the north and east sides. The entrance is off of 116th St. and there will be a stone entry wall accented with a wood fence. A rendering of the wall and fencing was shown. Yard lights and mail boxes will be provided by the developer. There will be single and two story homes ranging in price from $100,00o to •$150,000. The square foot range is from 1300 to 2200. Mr. Herringtori�questioned the water source,, sewer capacity and who will maintain the streets and park are4 after the developer has com- pleted the project. Judy Scott, 805 E. 116th St., questioned the height of the mounds and what will be -put on them, the right-of-way and entrance off of 116th St. at that point. Scott Dill, 11431 College, questioned the 40 ft. between his property and the development. Mr. Dill said he was in favor of the project, but is con- cerned for the water problem there. The public hearing closed at 9:35• Mr. Nelson responded stating that water will be provided by the Indiana- polis Water Company and that application has been made to the Clay Regional Waste District for sewer availability. The street system is to be dedicated to Hamilton County until the area is annexed into the City of Carmel, Mr. Nelson said they are not opposed to annexation. It will be the responsibility of the homeowners association to'maintain the park area and the entrance wall. The mounds will be 5 to 7 ft. high. The back yard is to be 65 £t. Site is zoned 3-1 and located north of 106th St. 2200 ft. east of the intersection of Shelborne Rd. and 106th St. in Clay Twp. Filed.•by C. Michael Verble. I The public hearing opened at 9:55 with Mr. Jim Nelson making the present- ation. Mr. Verble and Dennis Grump of Schneider Engineering were present. Each lot will exceed one acre in size and all of the homes will have not less than 3,000 sq. ft. of living area. The price of the homes will exceed $400,000. An aerial photo was shown to point out location. An artist's rendering of the primary plat was shown. There will be a single entrance from W. 106th St. The boulevard -will be 30 ft. wide and the cul-de-sac will be 26 ft. wide. There will be two lakes. The landscape plan was presented. There will be interior sidewalks and a sidewalk along 106th Street. Water will be provided by the Indianapolis Water Company, There will be individual septic systems on each lot. Mr. Nelson related that the Indianapolis Water Co. presently has a line w mile south on Township Line Rd, and this will be run north to this project and whether or not the water will be available to others in the area,.Mr. Nelson said he does not know. Dennis Grump explained the drainage The cul-de-sac is 600 ft. long, proposal. This item was sent to the Subdivision Committee for review on September 1, 1987 at the City Meeting Hall. Two Variances before the Board of Zoning Appeals have been filed•and will be heard August 24, 1987. One variance is for parking and the other' is for setback. Mr. Stewart said add •tiorial water and sewer availability has been re- ceived and all requirements are met. There are no changes to the elevations of the property. Stone and cedar materials will be used to match the existing structure. Mr. Stewart asked for approval of the revised plan subject -to the•two variances applied for. Mrs. Badger said Mr. Stewart is in compliance with their requests and moved approval of Docket No. 49-87 D.P. Seconded by Mrs. Lamb. Mr. Stewart related that this structure and storage area is totally for his law practice. Motion carried with Mr. Story voting NO. 2h. Mr. O'Neal questioned the removal of division corner. .,the hill in the road at this sub - Mr. Neal responded that the speed limit is 30 MPH there and the Board of Public Works sees no reason to out the hill down. Mr. Neal said the petitionex has agreed to pay half if this is found necessary. Mr. O'Neal strongly urged that something be done to lower that hill for safety reasons. Mr. Story related that the question of signage at the committee meeting was not resolved regarding 'the various signs requested. Mr. Kiphart said he feels a variance for signage is needed. Mr. Kiphart said to approve this tonight with the Dept, of Communit Dev- elopment to make the determination for one of the signs proposed. y • The motion to approve is contingent on Dept. of Community Development determination of the variances needed. Motion carried unanimously. 6h. Mr. Boone gave the Industrial and Commercial Committee report (which"is a part of the official minutes and attached to the master copy. The committee recommended approval and Mr. Boone so moved. Seconded by Mr. Story. Motion carried unanimously. 7h. The fixtures will be ground mounted. The proposal was explained. Mrs. Badger moved to suspend the rules and act this evening. Seconded by Mr. Boone. Motion carried. Mrs. Badger moved to approve Docket No. 78-87 ADLS as presented this; evening. Seconded by Mr. Boone. Motion carried unanimously. 3i. Commission to consider Docket No. 77-87 ADLS, the addition communication dish antenna for the 550 Building located on ional Blvd. in the Meridian Technology Center. Filed by Mark McDermott for Browning Investment Corp. This item is tabled. of a 6 ft. Congress- 4i. Commission to consider Docket No. 79-87 ADLS, Architectural Design, .3 Lighting, Landscaping and Signage review for the Wholesale Club, a 104,000 sq. ft. building to be located at the N.E.. corner of Congress- ional Blvd. and College Ave. in the Meridian Technology Center. Site is zoned B-2. Filed by David Jahn for Congressional Blvd. Investment Corp. This project has already been before the Industrial and Commercial Com- mittee for review. Mr. Story questioned the procedure of going to committee before being heard by the full Commission. Discussion on the matter followed. Steve Davis, Everett I. Brown Co. Architects and Engineers, made the presentation. The site plan was shown and location given. Landscaping with berms was shown. The tire storage area will be completely enclosed. The building will be constructed of gray block with a red stripe trim. The plans were explained. They request for the building two signs with internally illuminated lettere that comply to the ordinance requirements. The lighting plan for the parking area was presented. Because of a discrepancy .in the height of the stripe, Mr. Boone suggested that this item go back to committee for further review and clarification, and Mr. Boone so moved. Seconded by Mrs. Badger. The vote was 5 to 5 and the motion failed for lack of a majority vote. Mr. Kiphart said he has looked over the plans. Mr. Davis said that a committee report is needed in order to vote on this matter this evening. The petitioner related that they would put the stripe back to the 161" (red tile) as presented at the committee meeting. Mr. Kiphart related that the application shows the block to be beige in color with the red stripe instead of the grey as presented here this evening.
