Paul, my thoughts on this: you meet the intent of having a 10-ft planting strip adjacent to a street in the US 31
overlay. It just so happens that the planting strip is within the road right of way. I have spoken with the
Engineering Dept and the Urban Forester, and they have no issues with this location...all you need now is
consent to encroach approval from BPW. (I can put a copy of this email in the Plan Commission and BZA files to
show that this determination was made, if you wish.)

The reason I think the variance is necessary is that 23B.1 OB.(1) requires that the planting strip be "provided
adjacent to any Collector or Arterial Street or Parkway right of way with the U.S. 31 Overlay Zone." Since it will be
IN the right of way and not adjacent, I feel a variance is in order and can be conditioned upon the approval of the
consent to encroach. Your thoughts?

Do you think you still need a variance to have the planting strip in the right of way? I think that can be remedied
with the approval of the consent to encroach, through the engineering dept/ board of public works....

Engineering is acceptable to have the planting area encroach into the r/w. We do not want the planting area to be
in an easement though. The petitioner is preparing a consent-to-encroach for the plant material within the r/w.

Hello,
Just writing to see that you two are in agreement with the 10-ft planting strip location. Previously, the petitioner
was to seek a variance to reduce the 10-ft planting strip, but is now proposing the planting strip to be placed
within the Old Meridian right of way to meet the planting strip requirement.
