Cc: Griffin, Matt L Subject: RE: pinnacle pointe - planting strip location Paul, my thoughts on this: you meet the intent of having a 10-ft planting strip adjacent to a street in the US 31 overlay. It just so happens that the planting strip is within the road right of way. I have spoken with the Engineering Dept and the Urban Forester, and they have no issues with this location...all you need now is consent to encroach approval from BPW. (I can put a copy of this email in the Plan Commission and BZA files to show that this determination was made, if you wish.) Since it will be IN the right of way and not adjacent, I feel a variance is in order and can be conditioned upon the approval of the consent to encroach. Your thoughts? Best Regards, Paul Paul G. We do not want the planting area to be in an easement though. The petitioner is preparing a consent-to-encroach for the plant material within the r/w. Previously, the petitioner was to seek a variance to reduce the 10-ft planting strip, but is now proposing the planting strip to be placed within the Old Meridian right of way to meet the planting strip requirement.
