Old Meridian Professional Building (Pinnacle Pointe) The applicant seeks approval for the following development standards variances: Docket No. 06030019 V ZO Chapter 23B.08.01 build-to line Doeket No. Ofi030020 V ZO Chapter 23B.I0.02.B(I) plamtiBg strip WITHDRAWN The site is located at 12065 Old Meridian Street and is zoned B-6/Business within the US 31 Overlay. Filed by Paul Reis of Bose McKinney & Evans LLP. General Info: The petitioner requests variance approval to have the building sit on the road right of way instead of being 20- ft back from it. Regarding the planting strip requirement, the petitioner will shift the required planting strip along the road right of way to be within the road right of way. This will allow the petitioner to comply with the planting strip setback, and so the petitioner withdraws Docket No. 06030020 V. A consent to encroach (into the road right of way) approval is need from the Engineering Dept & Public Works for this planting area. Analysis: The petitioner proposes to construct a medical office building. The site is uniquely triangular in shape and requires a variance approval to design the site and building location so that it is complementary of the Old Meridian District and the US 31 Overlay. The petitioner tries to meet the Old Meridian Plan (Old Meridian Task Force Report, Comprehensive Plan) which shows a possible site plan of a building pulled up to the north comer of the site, with parking to the south of the building. Findings of Fact: build-to line 1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: the building's proposed location of O-ft from the proposed road right of way will add character to the site and to the Old Meridian District. The planting strip will be located within the proposed right of way, but outside of the existing roadway. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the building's proposed location ofO-ft from the proposed road right of way will add character to the site and to the Old Meridian District. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: the building will have to be shifted back 20-ft, which may negatively affect the site's layout and traffic flow, possibly rendering the project unfeasible. Recommendation: The Dept. of Community Services recommends positive consideration of Docket No. 06030019 V with the condition that the consent to encroach is approved for the planting strip.
