Butts FINDINGS OF FACT - USE VARIANCE 1. The granting of this variance will not be contrary to the public interest, due to the existence of special conditions such that enforcement of the zoning ordinance will result in unnecessary hardship because: the current zoning immediatelv surrounding the DrODertv in auestion has resulted in the subject DrODertv. which has been vacant for aDDroximatelv three years. being more desirable for commercial use rather than residential use. By allowing the use variance. this vacant and dilaDidated DrODertv will be cleaned and renovated and comDlement the DroDertv's surroundings. 2. The grant of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: the DrODertv has been vacant and in a dilaDidated condition for aDDroximately the last three years. and the variance will result in the DrODertv being cleaned. renovated. and used in a manner consistent with the its surroundings. 3. The use or value of the area adjacent to the subject property will not be substantially affected in any adverse manner because: the majority of the DroDerties immediately adjoining the subject DrODertv are already zoned for commercial use. Those DroDerties not zoned for commercial use will be Dositivelv imDacted because the subject DrODertv. which has been vacant and in a dilaoidated condition for aDDroximately three years. will be cleaned and renovated. Additionally. the nature of the DroDosed use as well as its hours of oDeration will have little imDact on the surrounding DroDerties. 4. The need for the variance arises from a natural condition peculiar to the subject property because: desDite the majority of the DroDerties immediately surrounding the subiect DrODertv being zoned for commercial uses. the current DrODertv remains zoned residential and is immediately adjacent to u.s. 31. 5. The granting of this variance does not substantially interfere with the Carmel/Clay Comprehensive plan because: the nature of the DroDosed use is not ofa community or regional serving nature and is comDatible with the surrounding uses.
