LU 26.04 Perimeter Buffering Requirements. 26.04.01 The requirements of this Section shall apply to all Special Uses, Subdivision Plats, properties containing multi-family uses, and properties within all Business, Manufacturing, and Industrial districts, unless other buffer or perimeter planting standards are specified within an individual district or zone. 26.04.02 Where required, perimeter buffering shall be located along the front, side and rear lot lines of a lot/parcel and shall extend the entire length of the front, side and rear lot lines. 26.04.03 Where residential or other buildings back onto a public thoroughfare, buffer plantings shall occur outside of the public right-of-way, per the Tables below. 26.04.04 Perimeter buffering shall not be located within any portion of a dedicated public street right-of-way, private street right-of-way, or County regulated drain easement. 26.04.05 Existing vegetation may be used to achieve project buffering if: (a) the vegetation located upon the subject parcel is of a quality and state of health to achieve buffering, and, (b) the vegetation is proposed to be preserved using accepted best management practices for tree protection during construction. 26.04.06 To determine the applicable bufferyard requirements: (a) Use the Table for Bufferyard Determination to identify the land use category of the proposed project use. (b) Use the Table for Bufferyard Determination to identify the land use(s) of the adjoining properties, or identify the street classification adjoining the proposed use by referring to the Official Thoroughfare Plan of Carmel-Clay Township. This the buffer yard ordinance, and so I would say that it would be a lot cheaper for you to leave the natural vegetation that is existing there now. I would generally say that I am not opposed to adding some parking in the northeast corner adjacent to the existing parking, but not a lot. The elm is mostly dead, but the other trees are good candidates for preservation. The original site plan I was given shows that the northeast corner of the site was to remain wooded, but the revised site plan shows this as additional parking. Will this parking be paved & curbed? If not, you will need to fill out a variance application to not have a curbed/paved parking area. Also, please calculate the percent of lot cover, using pavement area and building footprint~. You may also need to fill out a variance application for percent of lot coverage; the R-1 district only allows a 35% lot coverage. Attached is the development standards variance application and instruction sheet. Mom thought she needed to educate me about the BZA..... still trying to teach me at 57 years old.. see... mom's never quit... and she is 88!!! I wish you would have stopped by for a visit... I would have loved to show you what we have in mine... We are definitely going to make it very cozy home. Lots of ginger bread stuff and curb appeal.. We will show all that on the finish drawing of the house. It will not look or resemble any thing commercial or office type. Since the house is backwards to Smokey Rd. we are going to give the house three fronts... Lot's of flower beds all around the house and arbors... I can't wait to give that poor old house new life... We want to make the drive wider and keep it where it is. I think that would be safer for everyone. All weeds and under brush will go and we will put in colorful shrubs, add more trees to hide the parking lot and hwy 31, also a shadow box fence to hide hwy 31 from the house. I'm glad you don't think we need an attorney because we can use that money for flowers and pretty stuff...Thank you Angie you always make me feel better after I talk to you. To answer your question, I think if you can provide a thorough application, explanation, site plan, and building elevations, you will not need an attorney to represent you. I visited the site today, and think you can talk to the Board about how it is easy to turn onto the road from your site; no hidden drives or blind spots with the road curving the way it does. I think your sign should not be too large, but large enough for people to see from the road. The area seems very residential and low density, so the more you can make the building look like a house, the better. The wooded areas will help hide the parking lot, too, which is good. Jennifer thinks that we should contact an attorney to represent us. Do you feel that is necessary? She thinks that we will not represent ourselves properly. I feel like I can. What do you think would be best? I respect your input on this because I really do not know what to expect from the zoning board panel. I watched the meeting last night at my moms, of course it was Kingswood verses Martin Marietta which was huge compared to us. But it intimated me. Thank you for all your help.
