Michael:
That is okay, but at the meeting at 6 pm on April 24, the Dept will have to request that the Board suspend it rules
in order to hear your item with the 10 days notice prior to the meeting instead of the 25 days notice. The docket
no. assignment email stated a public notice requirement of 25 days because there will not be a Hearing Officer
agenda this month; there will only be a regular BZA meeting. No worries!

I have sent the Public Notice to the Indy Star and have the Adjoiner (Notification List) from the Hamilton County
Auditor and the Notices are ready to be sent via certified mail.
Per our original discussions I needed to have the Notices Published/Sent 10 days prior to the BZA Meeting April
24th. Is it okay to proceed or have I missed the date? Your E-mail to me was dated 3-27-06 three days after the
deadline stated below.
Please let me know I can still proceed.

The applicant seeks approval for the following development standards variance:
Docket No. 06030026 V ZO Chapter 25.01.01.B.3.ii accessory building setback
The site is located at 1558 Preston Trail and is zoned S-1/Residence.
Filed by Dillon Construction Group for John & Jennifer Rulli.
Petitioner, please note the following:
1. This Item will not be on an agenda of the Technical Advisory Committee.
2. Mailed and Published Public Notice needs to occur no later than Thursday, March 30, 2006. Published
notice is required within the Indianapolis Star. Note: the BZA meeting will begin at 6 pm and will take place
in the Council Chambers.
3. The Proof of Notice will need to be received by this Department no later than noon, March 24, 2006.
Failure to submit Proof of Notice by this time will result in the tabling of the petition.
4. The Filing Fee and Nine (9) Informational Packets must be delivered to BZA Secretary Connie Tingley
no later than NOON. Friday, April 14, 2006. Failure to submit Informational Packets by this time will result in the
automatic tabling of the petition to the May agenda of the BZA.
5. This Item will appear on the April 24, 2006 agenda of the Board of Zoning Appeals under Public
Hearings.
6. The petitioner will need to provide a fully filled-out Findings-of-Fact sheet for each petition the night of the
meeting for the Board's use (Sheet 8). On Ballot sheet, only fill out docket number, petitioner, and date (Sheet 7).
Ballot sheets must be collated.
7.) PETITIONER: refer to your instruction sheet for more details.

1.) Make sure the public notice to the Indianapolis Star newspaper by Noon two days prior to the public

2.) Provide a filled out and notarized Petitioner's Affidavit of Notice of Public Hearing (pg 6 of the
application).
3.) Provide the distance of the garage protruding past the front building setback line.
4.) Provide a copy of page 5 of the application, fully filled out (Notice of Public Hearing).
5.) Please provide an area location map.
6.) Show/label the distance of the garage from the house.
7.) Provide paper copies of the site plan and garage elevations.
8.) Please finish each sentence on the Findings of Fact sheet, page 8 of the application.
9.) Please provide a copy of the official list of adjacent property owners from the Hamilton County
Auditor's office.
