Broadway Fortville, IN. 46040 Docket No. PZ-2022-00128 V UDO Section 5.02(B)(1)(a) We are requesting a variance to the standards to allow the construction of a pergola inside the back yard of a fenced in property. The lot has a hardship due to the fact it is a corner w/3 street frontages. The current mature trees on sight are dying & no immediate relief or sizable replacement can be installed besides the pergola option. In addition to the fence and the pergola being close to the house additional replacement evergreen trees will be installed between the Fence and the road frontage immediately after pergola installation to provide long term green space buffer. The design created will not create any Siteline challenges for drivers/neighbors or have impact on property value. The location of the pergola and the topography of the yard have all been thought out and carefully considered In the design process. This structure is in very close proximity to the primary residence and is encompassed in a screened, fenced in and buffered back yard. 2. The implementation of the project uses design elements and features that can be found quit frankly in numerous applications commercial and residential around Carmel. 3. Due to the sites topography and drainage set up, building the pergola on the opposite side of the pool will result in retention requirements and sight line interference to neighbors.
