Ordinance Z-488-06 (Docket No. 06030009 OA): Use Table Amendment
Petition to amend the Zoning Ordinance in order to amend the Schedule of Uses in Appendix A.
Filed by the Carmel Department of Community Services.
Please find enclosed the Plan Commission-certified ordinance to amend the Zoning
Ordinance Appendix A: Schedule of Uses. Proposed amendments are summarized as
follows:
APPENDIX A: SCHEDULE OF USES
1. Remove uses including Surgery Center, Urgent Care, Cafe, Delicatessen and Coffee
Shop; they are only listed as "permitted" in the Old MeridianlMixed Medical District. In
a previous re-organization of Appendix A, many uses were consolidated into General
Retail, General Service, Clinic or Medical Health Center, etc., and these should have
been done at that time. (pp. 2 & 3)
2. Allow General Retail in the B-5. (pg. 3)
3. Allow General Service in the B-5 and OMlMixed Medical. (pg. 3)
4. Allow Restaurants, without drive-thru in the B-7 and M-3. (pg. 4)
5. Move Commercial Parking Lot use from Miscellaneous to Transp. & Comm. Category.
(pg. 5)
6. Add Private Parking Area as an accessory use in the Transp. & Comm. Category. (pg. 6)

7 An Ordinance Amending the Schedule of Uses of the Carmel Zoning Ordinance
8
9 WHEREAS, pursuant to the Advisory Planning Law of the State of Indiana (contained in
10 IC 36-7-4), each unit of local government that wishes to adopt land use and zoning ordinances
11 must first approve by resolution a comprehensive plan for the geographic area over which it has
12 jurisdiction; and
13 WHEREAS, the 2020 Vision Comprehensive Plan (the "Comprehensive Plan") Docket
14 No. 16-96 CP was given a favorable recommendation by the CarmeVClay Advisory Plan
15 Commission on August 20, 1996, and duly approved by Resolution No. CC-09-03-96-03 of the
16 Common Council on September 24, 1996, and is therefore the official Comprehensive Plan of
17 the City of Carmel and Clay Township; and
18 WHEREAS, the City wishes to maintain an orderly, consistent and streamlined Zoning
19 Ordinance; and
20 WHEREAS, pursuant to Indiana Code 36-7-4-602 the Common Council is authorized to
21 amend the text of the zoning ordinance; and
22 WHEREAS, pursuant to Indiana Code 36-7-4-610 and City of Carmel Ordinance No. D-
23 1600-02, the Carmel Zoning and Subdivision Control Ordinances are incorporated by reference
24 into the Carmel City Code;
25 NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
26 Carmel, Indiana, that, pursuant to IC 36-7-4-600 et seq. and after Docket No. 06030009 OA
27 having received a favorable recommendation from the Carmel Advisory Plan Commission on
28 Tuesday, March 21, 2006, it hereby adopts this Ordinance to amend the Carmel Zoning
29 Ordinance (Ordinance No. Z-289, as amended), as amended, to read as follows:

36 Section D: All prior Ordinances or parts thereof inconsistent with any provision of this
37 Ordinance are hereby repealed.

An Ordinance to Amend Appendix A of the Zoning Ordinance, in order to modify the schedule of
uses.

Dear Members:
The Carmel Advisory Plan Commission offers you the following report on the application to the
Commission (Docket No. 06030009 OA) to Amend Appendix A of the Zoning Ordinance, in order to
modify the schedule of uses.
The Carmel Advisory Plan Commission's recommendation on the petition is FAVORABLE.
At its regular meeting on March 21,2006, the Commission voted nine (9) in Favor, zero (0) Opposed,
zero (0) Abstaining, to forward to the Common Council the proposed Ordinance Z-488-06 with a
Favorable Recommendation.
Please be advised that by virtue of the Commission's Favorable Recommendation, pursuant to IC 36-7-4-
607(e)(3), the Council has ninety (90) days to act on this petition before it becomes effective as Certified
by the Commission. Ninety days from the date of the original Certification (March 27,2006) is Sunday,
June 25, 2006.
