4. Docket No. 50-01 CA (Commitment Amendment): 1437 Keystone Way - Victory
Beauty Systems
Petitioner seeks Commitment Amendment approval to permit an additional sign. The site
is located at 1437 Keystone Way, northwest of the intersection of Keystone Avenue (SR
431) and East 116th Street. The site is zoned B-8/Business and is located partially within
the SR 431/Keystone Avenue Overlay Zone.

5. Docket No. 51-01 ADLS: 1437 Keystone Way - Victory Beauty Systems
Petitioner seeks ADLS approval for a sign. The site is located at 1437 Keystone Way,
northwest of the intersection of North Keystone Avenue (SR 431) and East 116th Street.
The site is zoned B-8/Business and is located partially within the SR 431/Keystone
Avenue Overlay Zone.
Filed by Kevin Miller of Action Sign Company for Victory Beauty Systems.
The applicant is requesting a commitment amendment to allow a sign to be located on the east
fa~ade of the subject building (see attached building elevation). When originally approved, the
applicant committed to forego signage in the proposed location to permit another tenant space,
without frontage on that side of the building, a sign located on the existing extended wall of their
space (see attached photo).
The Special Studies Committee continued these two items last month requesting that the
applicant provide the following:
1. A written commitment regarding future ADLS approval for the remainder of the building.
2. A revised landscape plan reflecting the proposed elevation drawings.
The applicant has provided these documents. However the Department feels that the
commitment should be revised (see attached commitment prepared by the department).
The Department recommends that the Special Studies Committee forward this item back to
the full Plan Commission with a favorable recommendation based on the commitment as
prepared by the Department.

Carmel/Clay Plan Commission per Docket Nos. 50-01 CA & 51-01 ADLS Amend.
3. The Applicant understands that the representations made above will survive the

integral part of any agreement to sell the Real Property.
Binding on Heirs, Successors and Assigns. These commitments are binding on the owner of the
Real Property, each subsequent owner of the Real Property, and each person acquiring interest in the
Real Property, unless modified or terminated by the governmental authority authorized to modify.
Recording. The undersigned agrees to record these commitments in the Office of the Recorder of

On Thursday, October 25, 2001, I e-mailed Wanda Taylor of your office a copy of the
Department's proposed Commitments for the aforementioned project. I hope you have had time
to review the document in the interim. If you have any comments or concerns regarding the
document, please contact either myself or Jon Dobosiewicz. I have also attached a hard copy of
that document for your use.
In that same e-mail, I also requested that Ms. Taylor apprise you of the Department's
need for certain documentation relating to this site. The fIrst is a copy of the most recently
recorded deed to the property. The second was a copy of the previously recorded Commitments
for this site with Book, Page and Instrument Number information. Please provide these
documents no later than the Tuesday, November 6, 2001, meeting of the Special Study
Committee.
On an unrelated matter, Jon has asked me to remind you to contact him as soon as
possible regarding the CH Land and CMC projects. There is outstanding documentation he
requires in order for those to move forward.

be accurate; however, will ask that she submit the required copies to you, the Urban

Thank you for faxing a dimensioned copy of the Landscape Plan to the Department on
Friday, October 12, 2001. While that will certainly help our review, the plan is not accurate in
terms of the placement and quantity of the plantings.
The plan shows a uniformly spaced row of thirteen (13), seven-foot-tall Pyramidal
Arborvitae planted adjacent to the east fac;ade of the building. The east elevation submitted by
Mr. Coots on Friday, October 12, 2001, however, shows twelve (12), six-foot-tall evergreens
(presumably the same Pyramidal Arborvitae) planted in a manner that does not obscure the
windows. The Department requires an accurate plan for review.
Please revise the Landscape Plan to reflect the proposed conditions. The Department
would like to receive the revised Landscape Plan in time to review and comment before the
Committee packets are mailed this Friday, October 19, 2001. Submit two (2) copies to my
attention, one (1) to the attention of Scott Brewer, the City's Urban Forester, and ten (10) to the
attention of Ramona Hancock, the Plan Commission Secretary.

Dear Mr. Miller:
This letter is in response to your Commitment Amendment petition for the property located at 1437 Keystone Way.
The following connnents need to be addressed and/or plans updated accordingly:
1. We need to have a site plan submitted identifying the location of the signs in relation to the street.
2. Pictures of the site from the street would be helpful.
3. A narrative explanation of the request would also assist the Plan Commission in making their
determination.
I have enclosed a copy of the meeting minutes from the Plan Commission meeting in 1984 when the commitment
was made. It appears that the larger tenant in the building has been permitted signage on their east wall of their
space in exchange for committing to forgo signage on the east wall for the subject tenant space. With this in mind
the Department will not be in a position to support your request. Rather we would suggest the larger anchor tenant
remove there sign on the east face of the building. If this were done the Department would likely support the
request.
Twenty copies of the information contained in the application as well as the information outlined above including a
narrative of the project will need to be submitted by noon on June 8 for distribution to the members of the Plan
Commission. If you have any questions or if I may be of assistance please do not hesitate to call.

(multi-tenant) located at 941 South Range Line Road in a B-7

Item 2: Development Plan and Architectural Design, Lighting,
Parking and Signage review for a multi-tenant (Guarantee Auto)
structure to be built generally at the N.W. corner of 116th Street
and Keystone Way south of the Noble Romans Restaurant in the
Keystone Square Shopping Mall area and within a B-8 Zoned
District.

Internal curbs are shown on plan.
All setbacks from streets are shown.
Line of site of roof equipment was shown from all angles.
1.x4" cedar boards will be used for screening if required.
Additional landscaping next to Noble Romans is shown. Buffer
will be a year round green belt; shrubs will be 4' to 6' high
at planting and will be placed 5' apart from center to center.
The elevation drawing was enhanced with colors to be used.
Painted split faced block will be in a natural limestone tone
and cedar trim in dark brown. (Samples were shown.)
Lighting: Lights on the front and back of building will be
wall mounted, shielded down lighting.
Signs: Petitioner is complying with the sign ~ode.
Business #1 will have a 35 sq. ft. sign.
Business #2 will have a 25 sq. ft. sign.
Business #3 will have a 25 sq. ft. sign. This business would
be allowed a second sign of 30 sq. ft. facing 431 Highway, but
petitioner is proposing an agreement in regard to that second
sign which will be presented later.
All signs will be individual letters, backlighted and cream in

It was moved and seconded that this Development Plan be approved
as presented including the roof top screening of the air
conditioning units and one 35 sq" ft. sign and two 25 sq. ft.
signs.

Mr. Kiphart requested that the I and C Committee review a
special request by Len Wolfson for the Guarantee Auto Bldg.
concerning the fourth sign that is allowed by Ordinance. The
petitioner would like to retain that sign for the nwner~t~nant
(Guarantee Auto); a 30 sq. ft. sign is allowed facing U.S.
Highway 431. This sign would be established on the extended
paraphet at the east end of the Guarantee Auto unit.
Mr. Wolfson offered to commit by covenant, to run with the land,
that the tenant at the east end of bldg. will only be allowed .
one (1) identification sign which shall face Keystone Way,
allowing the owner-tenant two (2) identification signs.
This covenant would be included in the Plan Commision minutes,
it would be in the Official File and in the Sign Permit File
for Guarantee Auto and legally recorded. Mr. Kiphart felt. this
was the best way to insure such an agreement. It also places
the responsibility of limited signage of one tenant upon the
owner of the building.
This proposal comes to the Plan Commission with unanimous
approval by the I and C Committee.

PUBLIC NOTICE REQUIREMENTS
The Commission shall require the Petitioner to notify by certified letter all persons deemed by
State Statute and the Commission to be interested as defined in the Rules of Procedure. Notice
of all hearings shall be published or sent not less than twenty-five (25) days prior to the Public
Hearing date (including the date of the hearing). The parties designated in the Rules of Procedure
will be the persons designated by the Commission as the party responsible for causing the notice
to be published. For the purposes of consideration, a newspaper or general circulation in the
county in accordance with the Indiana Code would be the Noblesville Daily Ledger (598-6397).
The following information shall be included in both the published legal notice and the notice of
interested parties:
(a) Docket number and the substance of the matter to be heard
(b) The legal description of the subject real estate
(c) . General location by address or other identifiable geographic characteristic of the property

CHAPTER 29: ADMINISTRATION
29.6 Filing Fees
Applications and petitions filed pursuant to the provisions of this Ordinance shall be accompanied by the
filing fees hereinafter specified, and shall be paid to the City of Cannel and collected by the Department of
Community Services.On or before December 31 of each year, the Director shall determine if
there has been an increase in the Consumer Price Index (United States city average)
prepared by the United States Department of Labor, by comparing the arithmetic mean of
the Index for July, August, and September of the current year with the same three-month
period of the preceding year. If there has been an increase, the increase shall be stated as
a percentage of the arithmetic mean for the three-month period for the year preceding the
current year (the Adjustment Percentage). The Adjustment Percentage shall be rounded to
the nearest one-tenth of one percent and may not exceed four percent, unless otherwise
provided by ordinance. Whenever the Director determines that there has been an increase,
the Director may make a corresponding adjustment to the filing and inspection fees
(Including late fees) that are assessed under this Chapter 29.6, in order to recoup
increases in personnel and administrative costs within the Department. However, the
adjustment may not be greater than the Adjustment Percentage determined under this
paragraph. The adjusted fees as determined by the Director under this paragraph take
effect on January 1 of the succeeding year.
