DEPARTMENT REPORT
MONDAY, AUGUST 22, 2022
(V) Phillips-Koerner Pool Variances.
The applicant seeks the following development standards variance approvals:
5. Docket No. PZ-2022-00125 V UDO Section 5.02 Pools to be located in side/rear yard and
minimum 3’ setback from easements required, Swimming pool & equipment located in Front Yard
and 0’ setback from easements requested.
6. Docket No. PZ-2022-00126 V UDO Section 2.04 Maximum 35% lot cover allowed, 37%
requested. The site is located at 13092 Harrison Drive (Mohawk Crossing Subdivision Lot 59). It is zoned
S1/Residence. Filed by Meagan Phillips and Nicholas Koerner, owners.
General Info & Analysis:
The Petitioner seeks approval to install a swimming pool and decking on the lot. The site is a Corner Lot, and it
is unique in that it has frontage on three streets: Main St., Harrison Dr., and Harrison Cir. This means that the
site also has three front yards. Please see the Petitioner’s info packet for more detail on the variance
requests.
Accessory uses/structures are not allowed in a front yard. They are also required to be located at least three feet
away from any easement. However, the Petitioner would like to install a pool and decking at the northwest
corner of the site. The pool and decking will be in the front yard and will also abut an easement, with 0-ft
setback from the easement. (The backyard area is currently fenced in with a wooden privacy fence.)
Also, a maximum of 35% lot cover is allowed, and 37% is requested.
The Petitioner addressed all planning/zoning review comments. The Planning Dept. supports the variance
requests.
Findings of Fact:

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of Docket Nos. PZ-2022-00125
and PZ-2022-00126 V, and with adoption of the Findings of Fact submitted by the Petitioner.
