The applicant seeks the following development standards variance approval: 7. Docket No. PZ-2022-00128 V UDO Section 5.02(B)(1)(a) Pergola / Accessory Structure cannot be forward of Principal Building, 13-ft encroachment requested. The site is located at 619 Woodbine Dr. East (Smokey Knoll Subdivision Lot 15) and is zoned R1/Residence. Filed by Chris Sander of Property Pros, on behalf of Thomas and Sharon Wood, owners. General Info & Analysis: The Petitioner seeks approval to install a 10-ft tall smart pergola structure with louvred roof on the lot, near the garage and driveway area. It will encroach 13 feet west of the garage door plane, when an accessory structure on a Corner Lot cannot be forward for any principal building. Please see the Petitioner’s info packet for more detail on the variance request. The site is a Corner Lot, and it is unique in that it has frontage on three streets: Woodbine Drive E., Smokey Ln., and E. 136th St. This means that the site also has three front yards. Accessory uses/structures are not allowed in a front yard. However, the Petitioner would like the pergola installed in a way that coordinates with the existing swimming pool. (The backyard area is currently fenced in with a wooden privacy fence, and evergreen trees are planted outside the fence.) The Homeowners Association for the neighborhood has also approved the project. The Petitioner addressed all planning/zoning review comments. The Planning Dept. supports the variance request. Recommendation: The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2022-00128 V, and with adoption of the Findings of Fact submitted by the Petitioner.
