DEPARTMENT REPORT
MONDAY, AUGUST 22, 2022
(V) Finerty Lot Cover Variance.
The applicant seeks the following development standards variance approval for a swimming pool & gazebo:
15. Docket No. PZ-2022-00146 V UDO Section 2.04 Maximum 35% lot cover allowed, 46%
requested. The site is located at 10429 Charter Oaks (Windemere Subdivision Lot 71) and is zoned
S1/Residence. Filed by William (Bill) and Theresa Finerty, owners.
General Info & Analysis:
The Petitioner seeks approval to install a swimming pool, pavilion/gazebo, and decking to the backyard of the
property. The maximum allowed lot cover is 35%, and the requested lot cover is 46%. This is a variance of
11%. Please see the Petitioner’s info packet for more detail on the variance request.
The pool pump equipment details have been provided; it will be of a quiet design. The pool equipment will be
located approximately 13 feet off of the north property line. (Comments received from the public relate to
concerns about pool pump equipment noise. There has been a request to also install mature landscape materials
to mitigate the noise, in addition to having a quiet pump model.)
The neighborhood homeowner’s association has also granted approval.
The Petitioner addressed all planning/zoning review comments. The Planning Dept. supports the variance
request.

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2022-00146
V, and with adoption of the Findings of Fact submitted by the Petitioner.
