Re: BZA Docket No. PZ-2022-00064 V: Herman Pool Setback Variance.
Dear Mr. Springer:
At the meeting held on Monday, August 22, 2022, the Carmel Board of Zoning Appeals Hearing Officer took the
following action regarding the Development Standards Variance (V) request filed by you for the property located at
3973 Bear Creek Way:
APPROVED with Conditions: Herman Pool Setback - Development Standards Variance approval for:
• Docket No. PZ-2022-00064 V: Minimum 3-ft setback from easement required, 14.5-ft encroachment into
easement & floodplain granted with the following Conditions:
• Condition 1: The Petitioner receives Consent to Encroach approval from the Carmel Building Department
(Carmel Board of Public Works & Safety), and
• Condition 2: The Petitioner receives Easement Non-Enforcement approval from the Hamilton County
Surveyor’s Office (County Drainage Board).
Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Development
Standards Variance approval is valid for three (3) years. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approval must
have been received and approval granted by this Department. The expiration date of the approval is Aug. 22, 2025.
Please include a copy of this letter with any permit application.
