Re: BZA Docket Nos. PZ-2022-00137 V, PZ-2022-00141 V: Hubler Accessory Structures Variances.
Dear Ms. Hubler-Lyskava :
At the meeting held on Monday, August 22, 2022, the Carmel Board of Zoning Appeals Hearing Officer took the
following action regarding the Development Standards Variance (V) requests filed by you for the property located
at 13350 Mercer Street:
APPROVED with Condition: Hubler Accessory Structures - Development Standards Variance approval for:
• Docket No. PZ-2022-00137 V: Accessory Buildings and Swimming Pools must be located behind primary
structure, Pool house and pool to encroach 38.5’ north of house, and
• Docket No. PZ-2022-00141 V: Accessory structures and Swimming Pools/Decking must be 3-ft off
easement; 0’ from easement granted.
• Condition: The Petitioner receives Consent to Encroach approval from the Carmel Building Department
(Carmel Board of Public Works & Safety) for any landscaping or hardscape/structures within the
easement.
Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Development
Standards Variance approval is valid for three (3) years. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approval must
have been received and approval granted by this Department. The expiration date of the approval is Aug. 22, 2025.
Please include a copy of this letter with any permit application.
