Agreed. I can confirm that I will leave ample distance to provide an adequate swale between lots 2 and 3. On lot
2, I am moving the house 5' to the south, creating more space between the driveway and the property line. I am
working on getting the plot plan re-drawn and the lot re-staked. Hopefully, I can get the new layout over tomorrow
morning.

Dave,
I think alii need for Lot 2 is some type of assurance that the drive being located in such proximity to the lot line
will still provide adequate area for a side yard swale. I think we had talked about the handing of the adjacent lot
may be such that both drives will abut this common property line and each will be set back sufficient distance to
allow for a reasonably mowable slope and a side yard swale for drainage. Please confirm and I will let Sarah
know that we are O.k.

The encroachments will only need to go to the County if the improvements encroach into a regulated drain
easement. If it is an easement other than a regulated drain easement, then the City will do a Consent to
Encroach.

this same issue. Will we need to talk with Ms. Garmon each occurrence?
Do you have any information on Lot 2? I don't think we had any issues encroachment issues on this lot.
