RE: Administrative Appeal Request; Willow Haven on 106th St, LLC Building Permit
Building Permit B-2020-01329
Dear Mr. Higgins:
You recently submitted an application on behalf of your clients, Hari and Saranya Nagireddy, to the Carmel
Department of Community Services ("DOCS"), requesting an administrative appeal in front of the Carmel Board
of Zoning Appeals (the "Application"). Specifically, you requested an appeal of the determination to issue
Building Permit B-2020-01329 (the "Permit") to James Miles on or about August 16, 2021 for the property
located at 2080 W. 106t' Street, Carmel, fN (the complete application for the Permit was received by DOCS on
December 15, 2020).
Pursuant to Carmel Unified Development Ordinance ("UDO") Section 9.01(B), it is my responsibility to review the
Application to determine whether it is both complete and in technical compliance with all applicable ordinances,
laws, and regulations. Upon review, the Application cannot be placed on the Board of Zoning Appeals ("BZA")
agenda because your appeal is not timely: the Application was not filed within thirty (30) days of the action to be
appealed as required by UDO Section 9.01(A).
This letter and the conclusions herein shall constitute an official determination of the Director. If you or any
interested party disagrees with this determination, a formal appeal to the BZA may be filed pursuant to UDO Section
9.01 (A). Any appeal to the BZA must be filed within thirty (30) days of issuance of this letter or the determination
will be final.
Sincerely,
Micha P. of ' ugh
