Petitioner, please note the following:
1. This Item will appear on the May 17 agenda of the Technical Advisory Committee. The site plan
submittal deadline to all TAC members is May 2.
2. Mailed and Published Public Notice needs to occur no later than Thursday, April 27. Published notice is
required within the Indianapolis Star. Note: the placement of a public hearing sign on the property is also
required by the BZA Rules of Procedure, Article VI, Section 6 (see attached pdf).
3. The Proof of Notice will need to be received by this Department no later than noon, Friday, May 19,
2006. Failure to submit Proof of Notice by this time will result in the tabling of the petition.
4. The Filing Fee and Nine (9) Informational Packets must be delivered to BZA Secretary Connie Tingley
no later than NOON. Friday, May 12, 2006. Failure to submit Informational Packets by this time will result in the
automatic tabling of the petition to the June 26 agenda of the BZA.
5. This Item will appear on the May 22, 2006 agenda of the Board of Zoning Appeals under Public
Hearings.
6. The petitioner will need to provide a fully filled-out Findings-of-Fact sheet for each petition the night of
the meeting for the Board's use (Sheet 8). On Ballot sheets, only fill out docket number, petitioner, and date
(Sheet 7). Ballot sheets must be collated.

FINDINGS OFFACF - USE VARIANCE
,1. 'fl!e grant of tbisvariance will not be contrary to the public interest, due to the existence of
sjJecial conditions(s) such that enforcement of the zoning ordinance will result in unnecessary
haldsbip because:
Martin Marietta's existing sand and gmve1processing facility has a scalOohouse, and
scales associated with the facility. This Board previously granted Martin Marietta's applicatiOn
under ~~ number UV,2302 to pennit the'mocation of the existing sand and gravel
~sing f8clfity,in ~ with tbewishes of the adjacent residents. Relocation of the
~d and gravel processing plant reasonably necessitates relocation of the scalOohouse and scales,
or trucks will have to go beck and forth across Hazel DellParkway to be weighed before and
after filling.Convel:sion of Ihe existing structure on the subject site to a scale house is an
appropriate use of this vacant improve~t. EnfolCCDleDt of the zoning ordinance will n:sult in
lJI1I1tlCeSsary h~p in that full relocation of the facility will be precluded, with the result that
the neighbors' wisbes will not be met. ' '
2. The grant oftbis variance wiU not be injurious to the public health, safety, morals and general
welfare of the commu1iity because:
Converting the existing structure em the site and operating the scale house and scale on
the same site as an integral part of Ihe processing plant will combine the operation aJ a l~ation
that is more distant from the majority of residential areas in the vicinity of the existing ~ons
and related traffic will be reduced from that which would exist if the variance were to be denleeL
,3. The use or value,pf the area adjacent to the subject property will not be substantially affected
in any adverse ID8IlIj.er because:
The entire sand and gravel processing facility and related scale operations will be
signifiC!mdy m~ distant from the majority Of residential areas in the vicinity of the existing
operations and will be buffeml and screened by the existing wooded area along the eastern side
of Hazel Dell Parkway, which will remain ~
4. The neCd for the Variance arises from a natural condition peculiar to the s~ject property
because:
The need for the varillnCe arises o~ 9f the desire to relocate all the e~sting operations ' '
pertaining to the sand and gravel processing facility further away from the neatby residential
areas to the west, arid the scale house and scllles ~ an essential CQmponent of that operation.

The Land Use Plan of the CanneJIClay Comprehensive Plan indicates that the subject
pnlpeIty lies in the 100 year flood plain and indicates~ that the area. is not planned for either
Residential Community use (even though lOcated hi the 8-1 District) or a R.egion8J and
Community Employment area; sand aDd gravel processing and associated operations are an
appropriate use in die floodway area. .. .
