Martin Marietta - Scale House The applicant seeks the following use variance approval: Docket No. 06040019 UV ZO Chapter 5.01 Permitted Uses The site is located at 10851 Hazel Dell Pkwy and is zoned S-l/Residence. Filed by ZeffWeiss oflce Miller LLP for Martin Marietta Materials. General Info: The petitioner seeks use variance approval for a scale house. The scale house facilitates the weighing of trucks entering and leaving the sand processing plant. Use variance approval is needed because this use is not listed in the Zoning Ordinance as a permitted use in the S-l/Residence district. Analysis: Currently, a residential structure exists on the subject site and is proposed to be converted into the scale house. If you look at the legal description of the sand processing plant in relation to the subject parcel, you can see that the sand processing plant parcel touches three sides of the subject parcel. Also, across the street is the site of the old sand processing plant (which is now located on the east side of Hazel Dell Pkwy). The sand processing plant east of Hazel Dell Pkwy received use variance approval from the BZA on June 30, 2005. The land surrounding this site is within the floodplain. This proposed scale house will be an additional component of the sand plant. The petitioner has written that truck traffic will only travel south of the site along Hazel Dell Pkwy. Also, no additional lighting will be added to the scale house at this time. A sign permit will be required for the new sign. Findings of Fact: Use Variance 1. The grant of this variance will not be contrary to the public interest, due to the existence of special condition(s) such that enforcement of the zoning ordinance will result in unnecessary hardship because: Three sides of the subject parcel are already being touched by a parcel approved for processing sand & gravel. To the west, across Hazel Dell Pkwy, a gravel mine exists. The scale house will be a component of the sand processing. 2. The grant of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The scale house will be a component of the sand processing, which is occurring on the parcel adjacent to the subject site. The scale house will house offices and it will facilitate the weighing of trucks entering and exiting the adjacent sand processing plant site. 3. The use or value of the area adjacent to the subject property will not be substantially affected in any adverse manner because: Three sides of the subject parcel are already being touched by a parcel approved for processing sand & gravel. To the west, across Hazel Dell Pkwy, a gravel mine exists. The scale house will be a component of the sand processing. 4. The need for the variance arises from a natural condition peculiar to the subject property because: The site is surrounded by floodplain. Three sides of the subject parcel are already being touched by a parcel approved for processing sand & gravel. To the west, across Hazel Dell Pkwy, a gravel mine exists. The scale house will be a component of the sand processing. s. The granting of this variance does not substantially interfere with the Carmel/Clay Comprehensive Plan because: The area is already predominantly mining in nature. The surrounding land is within the floodplain. The scale house will be an adjacent, complementary use to the sand processing plant. Recommendation: The Dept. of Community Services recommends positive consideration of Docket No. 06040019 UV.
