As you can tell by this late hour, the hearing finished at 11 pm. Zionsville's attorney stated that Wal-Mart could
not ask Zionsville to plat and give Development Approval in the jurisdiction of Carmel/Hamilton County. The town
had John Myers, HNTB, present a finding that the traffic approaches needed to be 300ft according to brand new
access INDOT rules. The drainage plans did not exactly work according to an HNTB engineer. Finally, Wal-
Mart's lawyer just was hard noised and told Terri Jones and Ed Mitro, town manager, that he did not need to
answer these questions from staff because this was ministerial. He did not want a continuance. The lawyer for
the town advised them that they should not bring up the traffic and drainage issues in their denial.
I would assume that Mike may want to speak with Ed or Terri to fully understand the issues. I have to hand it to
Carter again for recognizing that Wal-Mart was going to play one community off against the other.

Dear Board of Zoning Appeals Members:
We are the owners and developers of approximately twelve acres of real estate,
commonly known as Weston Pointe Development along the North Michigan Road corridor. We
are located to the east and across Michigan Road from the proposed Wal-Mart development. We
plan on developing our property for retail purposes and have been approved to do so by the City
of Carmel.
As an adjoining owner, we have received notice of the proposed Wal-Mart variance, and
the purpose of this letter is to let you know that we fully support the proposed development. We
have seen the Wal-Mart plan and believe that it will be a benefit, both to our property, as well as
the community.
If you would read this letter into the record when the Wal-Mart matter is heard before
your Board, it would be most appreciated.
