Dear Mr. Kemper:
At the meeting held Monday, May 22, 2006, the Carmel Advisory Board of Zoning Appeals took the following action
regarding the Special Use application (SU) and the Development Standards application filed by you for the property
located at the northeast comer of 106111 Street and Shelbome Road
APPROVED: Docket Nos. 060040011 SU and 06040012 V, Special Use application for special uses and
Development Standards application for building height with the following Conditions:
1. Dedication of Road right-of-way
2. Connectivity to the perimeter path with Phase I and Phase IT construction
3. Eliminate 17 parking spaces
4. Construct 4-foot berm, 20 feet wide and approximately 150 feet long during Phase I construction
5. 8-foot Norway Spruce or Canadian Hemlock on top of berm on 15-foot centers plus 8-foot
ornamental trees, all mulched
6. No improvement/construction zone between the berm and English Oaks
7. Brick trash dumpster enclosed and facing away from English Oaks Subdivision
8. Impact of outdoor lighting be minimized with shoebox lighting
9. Tall hedge shrubs on the north edge to block car headlights before parking lot is in use
10. Preservation of existing trees within the English Oaks common area within 10 feet of the property
line
Please be advised that per Section 21.02.07: Time Limit of the Zoning Ordinance, any person to whom a Special Use
is granted by the Board, under the procedures set forth in this chapter, shall have commenced continuous
construction of said Special Use or implemented said Special Use within one year of the date of the granting of the
approval or said approval shall become null and void. The expiration date of the approval is May 22,2007.
Please be advised that per Section 30.05.05: Time Limit of the Zoning Ordinance, the aforementioned Development
Standards Variance approval is valid for one (1) year. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approvals must
have been received and approval granted by this Department. The expiration date of the approval is May 22,2007.
When applying for applications for permits regarding the improvements contained within this approval,
please include a copy of this letter with your application materials in order to assist the Department's review.
