Petitioner, please note the following:
1. This Item will appear on the May 17 agenda of the Technical Advisory Committee. The site plan
submittal deadline to all TAC members is May 2.
2. Mailed and Published Public Notice needs to occur no later than Thursday, April 27. Published notice is
required within the Indianapolis Star. Note: the placement of a public hearing sign on the property is
required; see attached pdf.
3. The Proof of Notice will need to be received by this Department no later than noon, Friday, May 19,
2006. Failure to submit Proof of Notice by this time will result in the tabling of the petition.
4. The Filing Fee and Nine (9) Informational Packets must be delivered to BZA Secretary Connie Tingley
no later than NOON. Friday, May 12, 2006. Failure to submit Informational Packets by this time will result in the
automatic tabling of the petition to the June 26 agenda of the BZA.
5. This Item will appear on the May 22, 2006 agenda of the Board of Zoning Appeals under Public
Hearings.
6. The petitioner will need to provide a fully filled-out Findings-of-Fact sheet for each petition the night of
the meeting for the Board's use (Sheet 8). On Ballot sheets, only fill out docket number, petitioner, and date

Ordinance to permit (i) the dome portion of the Holy Trinity Greek Orthodox Church to

FINDINGS OF FACT - DEVELOPMENT AL STANDARDS VARIANCE
1. The grant of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because: the approval of this variance will have marginal, if any, impact on the
publiC health, safety, morals and general welfare of the community.
3. The use or value of the area adjacent to the property included in the variance will not be affected
in a substantially adverse manner because: the approval of this variance will have marginal, if any,

The purpose of this special use request is to allow the relocation of the Holy Trinity
Greek Orthodox Church from its present location to this Real Estate in order to (i)
accommodate the needs of a growing congregation and (ii) construct a new church
facility that is in a location closer in proximity to its parishioners.

FINDINGS OF FACT - SPECIAL USE
1. The premises in question is particularly physically suitable for the proposed Special Use
because: the church and its related services are permitted special uses under the S-l
residential district. and are presumed to be appro\lriate uses.
2. The Special Use will not injuriously or adversely affect economic factors, such as
costlbenefit to the community and its anticipated effect on surrounding property values
because: the church and its related services are permitted special uses under the S-1
residential district. and are presumed to be appropriate uses. This special use request
would permit a use that is less intense than other potential uses that are permitted under
the S-l zoning classification.
3. The Special Use will be consistent with social/neighborhood factors, such as
compatibility with existing uses and those permitted under current zoning in the vicinity
of the premises under consideration and how the proposed Special Use will affect
neighborhood integrity because: the church and its related services are permitted special
uses under the S-1 residential district. and are presumed to be appropriate uses. The
surrounding areas also are zoned S-1 residential district. and. therefore. the special use
would be compatible with existing uses permitted in the vicinity and also provide a
benefit due to the related services offered by the church.
4. The Special Use will not injuriously or adversely affect the adequacy and availability of
water, sewage and storm drainage facilities and police and fire protection because: the
proposed special use would have a nominal impact on water. sewage. storm drainage
facilities. and police and fire protection in the area.
5. The Special Use will not adversely affect vehicular and pedestrian traffic in and around
the premises upon which the Special Use is proposed because: due to the limited
worship services. with services occurring during non peak hours. there will be a limited
impact on vehicular and pedestrian traffic in the vicinity.

FINDINGS OF FACT - DEVELOPMENTAL STANDARDS VARIANCE
1. The grant of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because: the approval of this variance will have marginal, if any, impact on the
public health, safety, morals and general welfare of the community.
3. The use or value of the area adjacent to the property included in the variance will not be affected
in a substantially adverse manner because: the approval of this variance will have marginal, if any,
impact on the surrounding use or value of adjacent areas.
4. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property because: denial of this variance request will hinder the parishioners
of the Church from worshipping in the manner to which they are accustomed.
